Good morning:

It’s now 10:24 am EDT.

10:24 pm in Kuala Lumpur and Perth.

The searchers did not find anything during their daylight search and there is a possibility that the 79-foot-long object spotted by the satellite may have sunk out of sight.

Another possibility is the unidentified object may have been a shipping container that fell off a ship during a storm. I regard this possibility to be unlikely because containers are not that big.

Nevertheless, I’ve read estimates that as many as 10,000 shipping containers are lost every year. I would not be surprised to discover that a significant percentage of them were stolen and reported as lost at sea.

Yet another possibility is currents have carried the object beyond the area searched by the planes and the Norwegian container ship.

Bad weather and poor visibility have complicated the search so it’s possible that the object is still on the surface and will be found after the weather clears.

Patience, cooperation and perseverance are required.

Wouldn’t hurt to pray either.

We are fortunate to have someone in our group who is an expert regarding aviation and air traffic control (ATC). Towerflower has been an air traffic controller for many years starting in the military and later as a civilian.

Here is Towerflower’s take on what happened to MH 370.

Air Traffic Control uses two different types of radar. One is used in Terminal environments (basically located near airports) in which they control airspace from basically 18,000′ and below. They utilize both primary and secondary radar. Primary radar is just a slash (-) that shows up on radar. The STARS system that the US uses in most of their terminal facilities gives you the ability to tag a primary target–meaning we can have the computer track the slash and input the callsign, destination, an assigned altitude, and type aircraft. The computer systems will figure out the airspeed and will display that with the target, the only thing we cannot receive or know for sure is the actual altitude of the plane but if I assigned 8,000′ ft to it I can put in A080 as a reminder to me that was he assigned altitude.

Centers operate airspace typically 18,000′ and above and to operate in this airspace it requires an operational transponder, why? Because their system only follows secondary targets that they get from an operating transponder. Shut off or have a transponder go bad for whatever issue and the airplane will go into what we call “coast” It will track for a couple of sweeps and display CST (coast) and it will no longer display altitude and it will drop off the controller’s screen. Since you like 911 conspiracies, think of what the hijackers did, they shut off the transponders to make them invisible to the centers but the terminal facilities can and did still track them.

There is no radar over large expanses of open water, like the oceans. Controlling aircraft there is done by time. So much time has to pass before another aircraft is allowed to occupy the same intersection at the same altitude. Aircraft will give position reports as they pass by these intersections so that the times can always be updated and since there is no VHF radio coverage over the ocean it is done via the ACARS system and HF. A long range radar system will go out 200 miles but typical terminal facilities have shorter ranges. Radar coverage will “weaken” when you get to it’s limits, you might no longer pick them up at lower altitudes regardless whether they have a working transponder or not. There can also be “blind spots” caused by large buildings (as in height) and the terrain…..meaning mountains.

GPS in the aviation community is currently only used for navigation purposes and not radar tracking. The FAA and NASA are currently trying to develop the next satellite based system using real time tracking of planes using GPS, it is called NexGen and it is still many years from being implemented and does not exist yet, so in other words Satellites do not track airplanes for controllers.

As a controller, I can say it is quite possible for a terminal controller to ignore a primary target going across their screen if they didn’t have any planes near it for it to be a factor for their concern (calling traffic). Military units would track any unknown target, especially if ATC doesn’t call them to let them known of an aircraft with a malfunctioning transponder, coming into their airspace and that would cause many nations along the northern route to scramble their jets to investigate, there is no way China nor India would just let a jet come into their country’s airspace without sounding an alarm.

As a controller, my theory has been, that the jet suffered some sort of decompression or most likely smoke in the aircraft. Smoke from an electrical fire makes more sense since there were a series of failures to the avionics and radios. The pilot quickly programmed in a new heading to the closest airport that could handle their jet. Oxygen would not be turned on since oxygen and fire don’t mix well. With all the toxic types of materials on an airplane people would be quickly overcome by the fumes and pass out and die. I have heard that pilots have smoke hoods but that gives you only a couple of minutes. An airplane at 35,000′ getting down to the surface takes longer than a few minutes. With the pilots and everyone else overcome by fumes the airplane would continue on it’s last programmed heading and continue until it ran out of gas and went into the ocean. It is also possible for there to be a smoldering type of problem which would produce the smoke but not the increasing flames of a spreading fire.

Good morning:

Two Sides to a Story has been attending the demonstrations seeking justice for Kelly Thomas, the mentally ill (schizophrenia) and homeless young man who was suffocated and beaten to death by police officers at the Fullerton (CA) Transit Center.

The event was captured on video by a security camera and spliced together with audio recordings of the officers’s statements during the incident. The audio was captured by the body microphones that each officer was wearing.

Spliced together the recording of the incident lasted about 32 minutes.

The jury incredibly acquitted the officers.

Two Sides deserves accolades aplenty for her persistence and reporting.

Here are her comments about yesterday’s march in Hollywood.

I.

It was a fun protest, though carnivalesque in the way that downtown Hollywood is – definitely a big city feel. At one point a limo stopped and some familiar young face peered out, took photos and waved. Some actor or musician, I think.

LAPD bicycle cops lined the streets sans riot gear, unlike the Fullerton PD, who remained invisible until they decided to put on their show of force. Most of the folks arrested in Fullerton have a hearing on February 18.

I left early tonight, just after a lot of the more peaceful protestors left. Kelly’s mom and dad each gave a speech and honored an LAPD police captain, who seemed friendly and supportive, or at least trying to be, considering LAPD’s bad record and all the “jail killer cops” chanting.

Anonymous and the young anarchists in black were cranking up after the hippies and mainstream folks left, and last I saw them, they were, baiting cops and spoiling for a fight. I wouldn’t be surprised if someone got arrested later on.

II.

Here’s what the protest looked like from a distance. Far from being 5000 souls, but there may have been about 500 during the first two hours. We were allowed to march up Hollywood Blvd for a few blocks and then back to this spot near Hollywood and Vine.

III.

Oh, just remembered – they made the police chief or captain an honorary member of Kelly’s Army – that was interesting.

I should be saving these photos and pasting them to place everyone can see them – too tired. Easier to look for some other links.

IV.

Here’s a CBS video with a few details about the protest – many of these protestors are involved in going all over the state and trying to raise awareness about police brutality.

Should a victim represented by counsel be permitted to participate in a criminal trial

PYorck posted a comment last night on the Dr. Shiping Bao thread regarding a legal procedure in Germany that permits victims or families of homicide victims to play a role in a trial.

Here is his comment and my response.

What do you all think?

Here in Germany it is possible for victims of certain violent crimes or their families in case of homicides to play an active role in a trial as the ‘subsidiary prosecution’.

If they want to be actively involved, they are represented by a lawyer. During the trial this ‘subsidiary prosecution’ has most of the rights of the regular prosecution. They can introduce evidence, provide witnesses including experts, question both of those, make statements… They also get full access to discovery and are allowed to be present throughout the trial even if they are witnesses. The major things they can’t do is charging anyone and appealing sentences.

Obviously something like this could have made a huge difference in this case.

I am curious what you think of this?

My response:

My knee-jerk reaction is negative because I’m thinking that too many cooks can spoil the stew. With two lawyers pushing the prosecution in different directions, the prosecution might appear to lose focus, which a clever defense lawyer might exploit as an example of reasonable doubt.

On the other hand, the mere presence of the victim’s lawyer might function to keep the prosecution honest. I like that aspect.

I’m going to make a new post out of the idea. Let’s see what others think.

Good morning to all of our friends:

Crane has a post up about a pregnancy disaster in jail and I have a post about the Supremacy Clause trumping the Nullification Doctrine, which is quite popular with state’s-rights and 10th Amendment enthusiasts. This is the same crowd racist crowd that has supported and continues to support George Zimmerman. They want to re-fight the civil war to reestablish white supremacy and segregation and legitimize slavery through imprisonment and debt.

I think this group is far more dangerous to our collective peace and security than Muslim terrorists.

I am featuring Malisha’s comment this morning because I think she nailed why so many powerful and influential people decided to demonize a child and rig the outcome for George Zimmerman

I think we actually DO know the truth, but up until this very morning I had not put it into a sentence. The sentence it came to me through was Serino’s sentence when he began to gently — ever so minutely and shyly, like a little girl wondering, with her thumb in her mouth, if she could ask the regal old woman for a cookie — question Fogen’s story. Serino said, mid-sentence, after saying that Trayvon Martin was not doing anything wrong, “You’re still the good guy here.”

Those (and now, the individuals included in “those” is legion) who worked hard to exonerate Fogen after he murdered Trayvon Martin were essentially saying:

Fogen has to still be the good guy here.
No matter WHAT he did,
No matter WHAT WHOPPERS he told,
No matter how innocent and undeserving Trayvon was;
No matter what the facts show,
No matter what the forensics reveal,
No matter what the law says,
No matter what his intentions were,
No matter how many wrongs he committed,
No matter what the morality issues are,
No matter what (including but not limited to ANYTHING)

George Zimmerman has got to stay THE GOOD GUY here.

… why? …

Because if he is NOT,
THEN:

A white guy went out hunting and chased down an anonymous Black kid he picked and targeted like game in a forest,
and he chased him
and he scared him
and he killed him
and there is no excuse.
And he did it because he knew he could get away with it.
And he DID get away with it.

If a theorem is true, the contrapositive is true.

If a white guy is a good guy,
then he is right to target and kill a Black and blame the Black.

If he is NOT right
(to target and kill a Black and blame the Black)
then he is not a good guy.

Since this case started with everyone in power saying:

HE IS STILL THE GOOD GUY,

Then he had to be NOT GUILTY of any crime
because it HAD to be that what he did was right.

OtherWISE, all the wrongs the white South has committed
would make them NOT the good guys any more.

And Rick Scott would not put up with that.
State’s Rights.

Serino gave us the verdict in the very beginning:

“YOU’RE STILL THE GOOD GUY HERE.”

Let us know your thoughts on this matter and if you believe Michael Dunn’s prosecution and trial will be rigged in his favor for the same reason.

Good evening my friends:

Leroy Eugene Hudson wrote this thought provoking piece.

Truth first then justice.

We’re the ones that failed. Not us specifically, but the people who knew and understood the truth and common sense and had the format to speak out about it. We let another narrative take place so we can avoid calling what we are seeing what it really is.

For example:

We let the media tell us that GZ said the word punk instead of calling them racist for trying to clean something up that was so damn obviously racist.

We let the media actually argue that GZ got out of his car to look for an address when the audio says that statement is a big obvious lie that only a true bigot, not a dummy, a bigot would fall for.

We let them tell us that GZ and family isn’t racist when his own mother says she is a white Peruvian when her grandpa is black, his dad called black people the real racists, his brother castigated the entire black race as violent based on what 2 accused teenagers have done, and a cousin who confirms that entire family’s hatred of blacks. Nevermind the fact that GZ called the police exclusively on blacks including a 7 to 9yr old that was in a whole nother apartment complex alleging he’s suspicious.

We let them tell us that 30yr audio experts are hacks because they say it was NOT GZ. They acknowledge they don’t have a big enough sample to say it’s TM but they know it’s not GZ.

We let them argue that TM did a U-turn 5 minutes after GZ said he’s running because he knew GZ would be at the “T” 5 minutes later. We didn’t tell them how absurd that argument is.

We let them argue that TM is the type of kid that would turn around and beat a man to death and then go home and eat his snacks like nothing even happened which would only be believable if that kid is black, and hence a thug.

Then we’re supposed to believe that GZ didn’t get a toxicology test because they forgot? If I get hurt at work, they wont forget, if I get caught with drugs they wont forget, If I get in a car accident and someone gets hurt, whether it’s my fault or not, they wont forget. This man shot a child and was in custody for 5hrs and we’re supposed to believe they forgot? They didn’t forget, they covered for him because if he was clean they would’ve tested him and put it all over the news. He was dirty.

Then we hear a teenager screaming for help on tape, then murdered, then the worst of it all he’s slandered along with his entire family. Something that didn’t even happen to Scott Peterson(I now question his guilt) and Joran Vandersloot. I recognize that it’s necessary to slander TM in order to avoid the truth

But the worst is that the champions of justice worked hand over fist to hide the blatant murder of a child. And we never made that argument. So this is another case of where Stockholm Syndrome by blacks prevented blacks from getting justice.

Good morning:

Don West impeached his client with the legal document he filed yesterday titled, Defendant’s Specific Response to State’s Motion in Limine Regarding Self-Serving Hearsay Statements of Defendant.

He said at pages 2-3.

Witness 13 and his wife heard a commotion in the back of their townhome. They heard yelling and then heard a shot. Witness 13 grabbed a flashlight and went outside to see what had happened. Within seconds of the shooting, W13 approached Mr. Zimmerman who was staggering, bleeding and breathing hard. The witness observed blood on Mr. Zimmerman’s face and the back of his head consistent with someone having been injured in a fight. Mr. Zimmerman asked W13 if he was bleeding? Witness 13 said “Yes” and W13 asked Mr. Zimmerman what had happened? Mr. Zimmerman told W13 that the other person was “beating me up” and he shot him.

Within a minute or so, Sanford Police Officer Tim Smith arrived on foot at the location where Mr. Zimmerman and W13 were standing. Officer Smith spoke with Mr. Zimmerman at the scene upo his arrival. Mr. Zimmerman acknowledged being the person who fired the shot and that he had a firearm on him. Mr. Zimmerman spontaneously stated that he had yelled for help and that no one helped him.

With that fresh in your mind, please watch what the defendant told the police about those moments during his walk-through for the Sanford Police Department a little less than 24 hours after he killed Trayvon Martin.

You have succeeded in proving that your client lied.

Can you pass the straight-face test when you argue to Judge Nelson that the defendant’s “spontaneous” statements to W13 are reliable and accurate?

What is she going to think about your credibility and professionalism when the State shows her the walk-through video?

By the way, was his statement to the person he called on his cell phone another “spontaneous” utterance?

As long as you are spillin’ the beans, why don’t you tell us who he called and what he said.

FYI: A few minutes after I posted this article, I reversed the order of the two clips because #2, which is now #1, is more directly relevant given the focus of the article. I apologize for any confusion that may have caused.
