Hillary Clinton cynically uses Sandy Hook shootings for political gain over Bernie Sanders

Hillary Clinton is using the tragedy at Sandy Hook for political gain over Bernie Sanders. Yesterday, she tweeted,

@BernieSanders prioritized gun manufacturers’ rights over the parents of the children killed at Sandy Hook.

This is disgusting and it shows how little she cares about the feelings of the people devastated by the shootings. It shows how desperate she is and how low she is willing to go to beat Sanders.

Bernie’s alleged offense is voting against a bill that would have held gun manufacturers liable for murders committed with guns they manufactured. Although I detest guns, I would have voted against the bill because it would hold gun manufacturers strictly liable for producing a product that is legal to sell, possess and use even though they did not sell it to the user or have any knowledge or control regarding the decision to sell it.

Love it or hate it, the Second Amendment is here to stay until such time as it is repealed. That is not going to happen in the foreseeable future, if ever. That means gun manufacturers are going to continue to make and sell guns to gun shops who will sell them to the public for as long as the public is willing and able to buy them.

While we do have laws that hold manufacturers strictly liable for injuries caused by the products they make, the product must be hidden and defective when made. Otherwise, there is no liability.

Hillary is a lawyer and she should know this because it’s taught in every torts class in every law school in the country and torts is a required subject, not an elective.

Voting against a bill that would have been deemed unconstitutional is the right thing to do. Bernie deserves credit, not criticism, for doing the right thing.

Hillary deserves a double helping of criticism, scorn and derision for this cynical and desperate ploy for votes. She is repugnant.

I have said that I will vote for her if she is the democratic nominee because the republican candidates are so repugnant, but I am so disgusted with her that I might have to vote for Dr. Jill Stein.

    Wait — who proposed that stupid bill to hold gun manufacturers liable for murders they didn’t commit? Did Clinton vote for it? Was she involved in drafting it? Is she out of her mind? What committee did it come out of?

      Hi Malisha!

      I’m afraid that you have it backwards. The law in question, the Protection of Lawful Commerce in Arms Act, was passed in response to a rash of frivolous lawsuits brought by gun control groups, in the names of the families of murder victims, against gun manufacturers and sellers. These actions were intended to force the defendants out of business.

      Contrary to what its opponents imply, PLCCA doesn’t shield the gun industry from all lawsuits, but limits the grounds for civil action to situations where the defendant has acted in violation of the law, acted fraudulently, made or sold a defective product. or negligently entrusted a product to someone they had reason to believe was a danger to himself or others.

      It also bans armor-piercing ammunition and mandates the provision of safety locks or lockable containers with each gun sale.

    I hate guns. I wish Obama WOULD come take “our” guns. But guns are legally manufactured, bought and sold in this country. If there is something wrong with one such that it malfunctions, I could see holding the manufacturer responsible.

    I’m not sure I understand this. Y’all know I HATE guns and would be quite happy if there were none, but unless a gun is defective and malfunctions, how can you sue the manufacturer? If it is made, sold and bought legally, how can anyone be sued – other than a person who USES it negligently or illegally?

    If I run someone over with my Jeep, can Jeep be sued for MY
    negligence?

    • Congratulations, you just passed the strict liability question on the bar exam. The elements that must be proven to win a products strict liability lawsuit are:

      (1) knowledge of a hidden defect in the product that is likely to cause injury when the product is used for the purpose intended;

      (2) distribution of the defective product into the chain;

      (3) use of the product

      (4) injury caused by the defective condition (think exploding gas tanks on Ford Pintos when car hit from behind at slow speed by a vehicle that did not stop in time).

      Ford placed the gas tank just in front of the rear bumper instead of in the middle braced forward and backward to prevent rupturing the gas tank on a front or rear impact. Ford could have fixed the problem for chump change but refused to bear the cost or admit they did anything wrong. Result: lots of innocent people burned to death.

      That was also a negligent design issue, which was an alternative theory of liability.

      Rule: You always plead as many theories of liability as you believe you can prove. You can only get one recovery, of course
