Protesters are now being arrested for “suspicion of assaulting an officer.” What IS that charge? Is there a crime on the books called “suspicion of assaulting an officer”? Or they just make it up as they go along?

    • The situation was mischaracterized by someone who does not understand what happened.

A police officer can arrest someone for a felony, if they have probable cause to believe that the person committed that felony.

However, they cannot charge a person with a felony. Only prosecutors and grand juries have the power to charge a person with a felony.

After an officer arrests a suspect, she can either investigate and release the suspect, which is called an I&R, or she can take them to jail.

When the suspect is booked into jail after a felony arrest, jail personnel classify the suspect as booked for ‘suspicion’ of the felony for which they were arrested.

The correct way to have reported the arrest would have been to say the protester was arrested for assaulting an officer and booked into jail for suspicion of assaulting an officer.

      • Malisha says:

I expect soon that there will be a law passed in Missouri making it illegal to (a) wear a mask in public unless it is October 31 between the hours of 6 pm and 10 pm; (b) refuse to de-mask when demanded by a LEO; and/or (c) act uppity if you’re darker than white.
