Who is selectively leaking information to help Officer Darren Wilson UPDATED BELOW

Wednesday, October 22, 2014

Good morning:

We are witnessing a massive coordinated effort by unnamed officials to unlawfully influence public opinion and the members of a grand jury regarding the Michael Brown shooting by selectively leaking and spinning information in the police investigation file. The purpose of this massive propaganda effort is to discredit eyewitness accounts of the shooting, persuade the public that Officer Darren Wilson shot and killed Michael Brown in self-defense and condition the public to accept a decision by the grand jury next month to not charge the officer with a crime.

The St.Louis Post Dispatch reported today,

The official autopsy on Michael Brown shows that he was shot in the hand at close range, according to an analysis of the findings by two experts not involved directly in the case.

The accompanying toxicology report shows he had been using marijuana.

/snip/

A source with knowledge of Wilson’s statements said the officer had told investigators that Brown had struggled for Wilson’s pistol inside a police SUV and that Wilson had fired the gun twice, hitting Brown once in the hand. Later, Wilson fired additional shots that killed Brown and ignited a national controversy.

Now comes the spin.

Dr. Judy Melinek, a forensic pathologist in San Francisco, said the autopsy “supports the fact that this guy is reaching for the gun, if he has gunpowder particulate material in the wound.” She added, “If he has his hand near the gun when it goes off, he’s going for the officer’s gun.”

Sources told the Post-Dispatch that Brown’s blood had been found on Wilson’s gun.

Melinek also said the autopsy did not support witnesses who have claimed Brown was shot while running away from Wilson, or with his hands up.

She said Brown was facing Wilson when Brown took a shot to the forehead, two shots to the chest and a shot to the upper right arm. The wound to the top of Brown’s head would indicate he was falling forward or in a lunging position toward the shooter; the shot was instantly fatal.

A sixth shot that hit the forearm traveled from the back of the arm to the inner arm, which means Brown’s palms could not have been facing Wilson, as some witnesses have said, Melinek said. That trajectory shows Brown probably was not taking a standard surrender position with arms above the shoulders and palms out when he was hit, she said.

Let’s take it one step at a time.

1) [T]he autopsy “supports the fact that this guy is reaching for the gun, if he has gunpowder particulate material in the wound.” She added, “If he has his hand near the gun when it goes off, he’s going for the officer’s gun.”

Dorian Johnson said the officer backed up suddenly, blocking their way. The vehicle was so close that the door hit them when he opened it and attempted to get out. Mike pushed the door back and the officer reached through the open window, grabbed his arm and started pulling him. Mike resisted attempting to get away but the gun came out, a struggle ensued and a shot was fired inside the vehicle wounding him. Johnson saw blood on his arm. They turned and ran.

“If he has his hand near the gun when it goes off, he’s going for the officer’s gun.”

This is an overbroad, unprofessional and irresponsible conclusion to draw from merely reviewing an autopsy report and I do not believe any responsible and qualified pathologist would make such a statement. She cannot divine his intent from the autopsy report or recreate exactly what happened. The most that any responsible pathologist can say is that the injury as described in the report is consistent with or inconsistent with Dorian Johnson’s description of what happened.

Even if what he said is not true, and I believe it is, his statement is consistent with the injury described in the report.

Wilson is right handed and wears his gun in a holster against his right hip. I doubt Brown could have reached across Wilson’s body and seized the gun. Instead, I believe it’s more likely that Wilson grabbed the gun with his free hand as he held on to Brown and Brown struggled to avoid being shot and get away.

2) “She said Brown was facing Wilson when Brown took a shot to the forehead, two shots to the chest and a shot to the upper right arm. The wound to the top of Brown’s head would indicate he was falling forward or in a lunging position toward the shooter; the shot was instantly fatal.”

We know that Brown was at least 95 feet from Wilson’s vehicle when he was hit with the fatal shot and not 35 feet as claimed by the Ferguson police chief. ‘Lunge’ implies they were close together when Wilson fired the fatal shot, but none of the eyewitnesses, who, by the way did not know Brown or each other, said they were close together or that Brown was bull-rushing Wilson or that Wilson appeared to be in imminent danger of being killed or suffering a serious injury. No, they described an execution and two of them were white guys from another neighborhood. None of the witnesses had any motive to lie and every one of them was traumatized by what they saw.

‘Falling forward’ is a better choice of words.

Note that Dr. Michael Baden and Dr. Shawn Parcells, who performed the autopsy for Brown’s family, were unwilling to speculate on this point and their credentials are considerably more impressive than Dr. Melinek’s.

3) ” A sixth shot that hit the forearm traveled from the back of the arm to the inner arm, which means Brown’s palms could not have been facing Wilson, as some witnesses have said, Melinek said. That trajectory shows Brown probably was not taking a standard surrender position with arms above the shoulders and palms out when he was hit, she said.”

So, what? That does not mean his hands were not up before he was shot. Again, Dr. Baden and Dr. Parcells refused to speculate about what was happening or the order in which events occurred. Dr. Parcells warned that one cannot specifically say in what order the shots were fired or what Brown was doing when he received the shot to the arm because the shoulder, elbow and wrist joints permit considerable movement. One possibility he mentioned was that it might be a defensive wound to ward off a shot to the head, but he added, he could not be certain.

CONCLUSION

Some person or persons unknown is attempting to persuade the public and probably the grand jury not to indict Darren Wilson for murder by selectively leaking information and spinning it. This is criminal activity.

This article in the St.Louis Post Dispatch spin doctors the official autopsy report (that was not provided to Dr. Baden or Dr. Parcells) and a portion of Darren Wilson’s statement, which he initially refused to provide and now appears to have been molded to fit the known facts) to convince the public that Darren Wilson killed Michael Brown in self-defense, notwithstanding what all of the eyewitnesses said.

But it’s not limited to the St.Louis Dispatch.

Washington Post, Report: Autopsy analysis shows Michael Brown may have gone for Darren Wilson’s gun

New York Daily News, Michael Brown autopsy, officer’s account indicate teen went for Ferguson cop’s gun, had marijuana in his system: report
‘Hands up, don’t shoot’ protesters have it wrong, an independent review of Michael Brown’s autopsy reportedly shows. Nearly three months after unrest began in Ferguson, Mo., medical results point to a close-range struggle between the black teen and Officer Darren Wilson.

I already wrote about the dissembling on Sunday by the New York Times here.

I found my post, thank you very much for your information!!

    What happened to my post?

  3. THEONE362436LINDA says:

I believe it is a Police officer being the so-called source of office Wilson narrative.

This narrative can be proven to be a lie with just the audio recording of the shooting and the autopsy pictures. The source narrative does not confirm that Michael Brown was reaching for officer Wilson gun inside his officer Wilson SUV!!!

The first of the last four shots hit Michael Brown in his chest, which made his body start to bend over to fall. 1 Pow, there was a small pause.
The hands was raised in a surrendering gesture is now moving downward.

    2 Pow, 3 pow, 4 pow
Bullet 2 hit Michael Brown in his hand, the bullet angle was traveling from the direction of the top of his thumb toward his wrist, consistent with falling and bending forward and the audio recording shooting rhythm. The picture of Michael Brown laying in the street also proved that Michael Brown favorite the right side of his arm. His right arm is under his body, which shows that Michael Brown took his right hand as he was falling to the ground.

Bullet 3 hit Michael Brown above his eyebrows, that bullet travel down to his top his chest.

Bullet 4 shot in the top of his head and the bullet went straight into his brain and other body organs consistent with bending forward as he was falling to the ground!!

Listen to the audio of the last four shots, it does not support any other theories, it sounds like 1 a little pause 2,3,4.

Really listen to the whole audio recording, you will find out there was three pauses ( two short pulses and one long pause) and 4 volley of shooting from the ten shots.
    You can hear
    (1s) one shot
    (1p) pause
    (2s) five fast shots fired
    (2p) pause
    (3s) one shot
    (3p) pause
    (4s) than 3 fast shots.

It is very unfortunately that the whole Police Department, City Hall, the judges, the news reporters and the Caucasian who are officer Wilson supporters are consistently lying, racist, corrupt and obstructing justice by interfering with the investigation that should have already arrested officer Wilson for murder and going through the system procedures for a trial!!

All these individuals know when officer Wilson is found guilty for the murder of Michael Brown, he will be executed!!!!

So, my question is. Why is it so detrimental that they be corrupt to prove that officer Wilson is not a murder is worth jeopardizing their career?

    • I believe your analysis of the order of the shots is correct.

      Couple of points though.

      1) It’s not a death penalty case because it does not meet the statutory requirements for a death penalty case.

      2) I don’t believe they believe they are jeopardizing their careers because they’ve likely done this before and gotten away with it.

      Welcome to the blog.

  4. The same way that the right is releasing info to sway public opinion, are there any of us out there who have computer skills to come up with a computerized reenactment of what we KNOW REALLY happened? That would help the world to see that the blood in the car was not because of what the officer said, but what all the other witnesses said.Wilson grabbed him with his left hand and pointed the gun at him threatening to shoot. When Mike Brown fought for his life, he was shot and broke free to try and run but was killed like an animal.

  5. Timothy Whitehead says:

This whole thing is breaking my heart at how hugely UNJUST this farce of a grand jury proceeding is. The cops whole story is just way too specific. It is so crystal clear that whoever coached him and helped craft his story made sure to cover as many potential questions as possible. Example 1. in case they ask you why you did not call for backup?, you make sure to say that during the struggle he switched your radio. Example 2. in case they ask you why didn’t you use your pepper spray? You say I could not spray it in a confined space like that. His story is just waaay to tailored. Also, do any of you remember when that “FRIEND” of the officer named Josie called the radio station with the officer’s story many weeks ago? Well in her retelling of his own account, she says that the dirty cop said “he (mike brown),after running away, stopped turned around and began taunting me saying WHAT, ARE YOU GOING TO DO, TO SHOOT ME?”. That is a huge misstep in his story! WQe ow know that Mike was first shot at he car, so why would he run away, then turn around and say “WHAT ARE YOU GOING TO DO, SHOOT ME” , when he has already been shot?! This stinks, stinks, STINKS!!!!

  6. What the prosecuting attorney has done is turn the grand jury into a trial jury! They are weighing the “credibility” of witnesses to the extent that a trial court would. The prosecutor, IMHO, Is only “pretending” to seek an indictment! He is actually trying to avoid one! That is why he is flooding the GJ with “all” the evidence! That is why the “suspect” Dannen Wilson supposedly testified for four hours! Why do they say a grand jury will indict a ham sandwich? The GJ is a tool of the prosecutor and they are not supposed to “try” the case, only find probable cause! A real prosecutor, who wants an indictment puts on evidence that there is probable cause for a specific charge and that Is it! This prosecutor doesn’t believe a crime was committed and is using the GJ as a escape hatch! Imagine him doimg ths same thing for any other “criminal suspect”! The leaks are obviously orchestrated to preview the upcoming “no bill” result! It is a farce! It started with the police refusing to release the cop’s name and his story and incident report! The “prosecutor” is actually acting more like a defense attorney and the grand jury is “trying” the case!

    • MDX says:

This points to a fundamental flaw in our system of justice. A prosecutor and law enforcement have a close working relationship and, as such, there is an inherent conflict of interest when individuals who work for law enforcement are suspect of a crime.

A reform should be that there is another prosecutor whose sole function is to put criminal cops behind bars, where they belong.

      Checks and balances.

Instead, there is a way too large segment of our population that think the police and the legal system are noble and honorable, such that we can trust them to apply the law to themselves.

      How pitiful.

Thousands of black teens have been killed by police in the last decade at a rate 21 times that of white teens.

How many of those thousands were deemed due to a criminal act on the part of the police?

      ten?

      one?

      a hundred?

I bet that the rate of deeming one of these killing due to criminal acts on the part of the police is less than 1%.

Is it possible to be that “good” or “perfect”?

  9. MDX says:

I forgot to add that you grab the collar hard, twist the material and drive the fist into the neck to gain arm lock out.

It is very effective and strong.

  10. MDX says:

And where was Wilson’s left hand and arm during all this?

It is George Zimmerman II. In episode I, we are supposed to believe that George took 20 to 30 MMA style blows to the face and did nothing with his arms to fend them.

Now, if one accepts Johnson’s testimony that the left hand had a firm grip on Brown’s collar that Brown was trying to break away from, thus leaving Wilson’s right hand free, I feel that a more plausible story that fits evidence can be created.

For example, a collar grab creates a deleveraging effect on the victim wherein they can only lash out with blows that might hurt, but are not damaging beyond minor bruises or scratches.

    Try it.

Have a friend grab your collar and see how it becomes hard to deliver clean strikes.

And Wilson was also a big man. So I would assume his grip was a solid one.

And, if he grabs the collar and drives his knuckles into Browns throat, it becomes impossible for Brown to be able to reach the right side of Wilson’s body where the gun was.

And cops are trained to know all the leverage moves.

    • PhillyBoyRoy says:

What other security profession – besides Killer Racist Cop – would a man, a man who is supposed to be trained to deal with such violence, admit so readily to being beaten senseless by a teen? While armed.

      None.

And the only reason he’s making these absurd claims – PUNCHED THROUGH THE OPEN WINDOW???? GOOD LORD THAT IS THE DUMBEST JUNK IVE EVER HEARD SERIOUSLY NEXT TIME SOMEONE RUNS UP TO ME IN MY PARKED CAR AND PUNCHES ME THROUGH THE OPEN WINDOW, AFTER IVE LAUGHED AT THEIR WOEFUL ATTEMPT TO HURT ME, IM DRIVING AWAY IMMEDIATELY AND CALLING THE COPS – is because he needs to lie and has been coached to say this junk by his defense team.

Imagine every accused murderer got this special treatment!

Why does Darren “Racist Scum” Wilson get access to all the evidence against him, get permitted to carve out a nice story around these facts, and then get the ability to argue his case before it goes to trial?

Btw, it’s not going to trial, now is it?

    • PhillyBoyRoy says:

Wilson is willing to admit that he is a crummy fighter, poorly trained cop, and a generally weak man.

      Why?

  11. LLMPapa says:

As far as I’m concerned, the part of this tale that seals the deal as to believability deals with the cop’s radio.

Not only did this 18 yo baaad azz supposedly grab his gun, not only did this kid supposedly beat a trained cop to near unconsciousness, he apparently had the presence of mind to REALLY screw the cop by switching the channel on his radio so he couldn’t call for backup!

Wilson used his radio to report that shots had been fired and ask for additional cars, but during the struggle, his radio had been switched from the Ferguson channel, the source said.

I chit you not. that’s this killer’s story.

  12. LLMPapa says:

    More from this “leak”:

Brown slammed its door shut and punched Wilson in the LEFT side of the face

    THEN:

During the struggle, Brown handed the cigarillos to Johnson, then swung his left hand and hit Wilson on the RIGHT side of the face.

DURING the struggle, between a left/right one two punch, this 18 yo kid handed cigarillos off to Johnson?

What’d he do, call timeout or something?

“Hey Dorrian, come here and hold this chit!”

    • MDX says:

In these scenarios, the killer mysteriously has no arms to block or fend blows and the victim has a third arm to hand off cigarillos or reach around for a gun.

    • girlp says:

Again the magical fighting black man, fights like jet lee.

    • Bill Taylor says:

that was a roundhouse hook with the left hand THROUGH the door post through the steering wheel around the equipment then coming BACK from the passenger side to hit wilson on the right side of his face…….only idiots can believe anything in wilsons 3rd hand nonsense.

  13. LLMPapa says:

Never thought I’d see the day that a fairy tale would make Zimmerman look like a rocket scientist.

    This “leak” says:

When Wilson tried to get out of the SUV, Brown slammed its door shut and punched Wilson in the left side of the face through the OPEN WINDOW, the source said.

    Then says:

Wilson told investigators he thought the bullet had struck Brown in the hand, the source said. BROKEN WINDOW GLASS WAS EVERYWHERE, and blood was on the door

Uhhh….if the window was rolled down and open, where’d all this broken glass supposedly come from?

  14. Nef05 says:

Feds are p/o’d. Investigating LEOs blame it on feds or anyone but themselves and decline to investigate (surprise – not). Black newspaper editor is offered leaks by LEOs and declines (but you know LEOs say it’s not them, and nevermind what the black paper’s editor says cause, you know – black).

It is a helpless feeling to sit here and watch this blatant BS happening right before my eyes and realise they’ll probably get away with it. I have NO faith in this grand jury. Less than none, actually. Feds are investigating Ferguson PD, not the St Louis dept that’s “investigating” this case. Reporters are not going to give up their sources, and this prosecutor is literally subverting justice just as clearly as Darren Wilson executed Mike Brown.

Justice Department condemns Ferguson leaks as effort to influence opinion.

Now they are saying several “black witnesses” are backing up Wilson but are afraid to come forward because of their safety. The fix is soooo in.

    http://www.huffingtonpost.com/2014/10/22/michael-brown-shooting_n_6030220.html

    • Nef05 says:

They’re lying. I know you know that – but I had to say it anyway. At best, they’re spinning the testimony as supporting Wilson, when in actuality, Wilson crafted his story to fit the testimony of the eye witnesses. Is WaPo a Murdoch paper? I know it leans right, but is it full wingnut?

The same goes with the selected “leaks that back up Wilson’s account”. They don’t back up his account. He crafted his story around that info. We’ll never know, but I wouldn’t be surprised if Wilson had been given copies of the evidence/reports weeks ago. The lack of integrity regarding this case is beyond appalling. Everyone in this country should be outraged at the perversion of justice, out of Ferguson, they are blatantly flaunting to the entire world.

      • MDX says:

It is embarrassing as how South Africa used to explain the deaths of an inordinately high number of black political prisoners as due to “natural causes” or “an accident”.

    • bettykath says:

Those witnesses are probably facing serious criminal charges of some sort, much like the witnesses against Mumia.

      • Nef05 says:

You think “deals” were made? Interesting, Bettykath. Great point. I wouldn’t put anything past this prosecutor. After the attention garnered when it was revealed how Ferguson was basically running it’s town on court fees/fines from the AA community, a few less defendants wouldn’t even be noticed.

  16. Nef05 says:

Expert claims autopsy findings were taken out of context in article. Despite that, when O’Donnell makes the same arguments the professor makes, she tries to “explain”. She’s on my last nerve.

    • Nef05 says:

Wondering, is there not a single black ME, in the entire country, they could have sent that autopsy report to? Someone who the community of Ferguson might be willing to give the benefit of the doubt? At this point it just looks like they don’t even care about trying to look unbiased. This is just blatant and overt.

    • bettykath says:

While she did say that the autopsy results supported Wilson’s story, she admitted that they could support other scenarios but she didn’t have the witness statements. Apparently the only thing available to her was Wilson’s statement and, yes, it could have happened that way.

O’Donnell also made a point that there are two people with access to Wilson’s story, the prosecutor and Wilson’s attorney. The prosecutor denied that the information came from his office and there was no response from Wilson’s attorney. Now would it make sense for Wilson’s attorney to put his story out there?

      • Nef05 says:

Yes, it would. That’s from the O’Mara “taint the potential jury pool” playbook, being used to influence the grand jury – who have already heard the story, but will find it easier to no bill Wilson if all their family/friends are on board. They will not only not face any backlash, but may get pats on the back for standing up against “injustice” to Darren Wilson.

That will be important when Ferguson burns.

    • Bill Taylor says:

her claim his hands couldnt have been up are based ONLY on the first shot…….she clearly is NOT intelligent and how she got a license astonishes me……….

      • Nef05 says:

A lot of what she said didn’t make any sense to me. The mere fact that she came on to speak of how she was taken out of context – then used the time to double down and try to justify what she claimed was taken out of context – lead me to determine she was unintelligent and incompetent. (JMO)

Now, having read Crane-Station’s post in the comments of the new article, connecting the ME with the tree-dwellers, I have determined she is not only unintelligent and incompetent, but also biased. (JMO)

I don’t know why people can’t just do their jobs and let the chips fall where they may.

  17. Carlyle Moulton says:

One thing that need clarification is the tone of voice and words officer Wilson used to tell Johnson & Brown to stop jaywalking.

When a police force acts as an army of occupation and one of the soldiers of this army gives orders to the occupied in a sufficiently scornful tone of voice and with sufficient references to sexual intercourse and genitals there is a high probability that the recipients of the orders will be so angered by the attitude expressed that they will see complying with the orders as a humiliation, and that is why Brown & Johnson replied that they were going to continue to J-walk until they reached their nearby destination.

Then there is the issue of the strong arm robbery and theft of the cigars or allegedly paid for cigars. I am puzzled why information clarifying this has not been forthcoming, could one or both sides on this question find value in failing to clarify it.

    • roderick2012 says:

If Wilson were so concerned about the jaywalking he should have stopped and talked to them and not yelled obscenities while passing them.

But he was upset and that’s why he had to tell the story about the events preceding the encounter with Brown and Johnson to prove that he was calm and not angry or upset.

And Turley fought for six years to defend the “liberty interest” of alleged pedophile Eric Foretich to visit his daughter while ignoring the LIFE INTEREST of his daughter not to have to have unsupervised contact with someone she claimed had raped her.

We could never get Turley to spend five minutes advocating for the LIFE INTEREST of endangered children. I’m through with him and to me, he’s in the same category as Dershowitz.

  21. Diamonique says:

I though it was said that Wilson didn’t know about the so-called robbery until after everything occurred. Now he says he did know about it?

    • roderick2012 says:

Diamonique: I though it was said that Wilson didn’t know about the so-called robbery until after everything occurred.

Right and if he did know what kind of cop gets so close to the suspects that he can’t open the door?

Wouldn’t a normal cop assume that they may be armed so if Wilson had considered them suspects he would have left some distance between his SUV and Brown and Johnson.

None of his lie makes sense.

      This is George Zimmerman redux.

      • MDX says:

I read a post by a competent law enforcement officer that carved Wilson a new asshole with respect to procedure.

One thing he harped on was that and officer, when face with multiple threats, never moves close such that his gun could possibly be used against him.

In Montgomery County, the first officer or officers always keep a distance, watch and engage in dialog till back up arrives.

Assume for arguments sake, that the threat of Brown and Johnson was real. Pulling close like that would have easily allowed Brown and Johnson to shoot and kill Wilson, if they were real armed and dangerous thugs.

Gee, I would think even that use of force liar in the Zimmerman trial knows that keep back with a gun is the corollary to rush a gun and run from a knife.

Which leads me to find Wilson suspect.

He rushed with his car when in possession of a gun and kept close with the gun as he followed and killed Brown. He also let the other “suspect” get behind him as he followed Brown.

How did he know that Johnson was not armed?

Why, after one of the guys rushed to kill by physical force, did Wilson leave the other guy at his back?

That does not sound like the acts of a man who thinks he is faced with two potentially lethal threats. No, it looks like a guy who knows he has the upper hand. Or a guy in rage mode, blind to anything but harming the object of his blood lust.

  22. PhillyBoyRoy says:

How on earth did this pathetic excuse for a cop “nearly lose consciousness”?

    What does that even mean?

I’ve been in fights and never have I thought I was going to die.

And surely if I was armed during said fights, I would feel pretty safe.

Why are people buying this crud?

    Answer: they hate blacks

    • MDX says:

How come these guys like Zimmerman and Wilson, during a “reign of blows descending on thee”, never have arms and hand to fend?

Wilson has already claimed Brown is a “man mountain” who can deliver unleveraged punched with hands as heavy as George Foreman, so I got to ask:

Where are the bruises on Wilsons arms from trying to block some of that heat?

I mean, in the photo, Wilson is a large, kind of pudgy guy, dresses in light clothes, so I would expect a lot of pictures of bruises to more than just the face.

And in a life death struggle wherein Brown has to reach into a window opening that has hard edges, they must be some bruises on his arms.

Or did Wilson grab Brown by the throat, get some minor blows by Brown trying to break free, get mad, pull out the gun, and start shooting?

      Back to the BS story.

Ok, Brown has a thing {according to Wilson} secured with one hand that, if it get free, will kill him, but uses the other hand to give cigarillos to Johnson.

That, as the robot will say, does not compute.

      Fight or flight.

If it is fight, then the primal instinct is to fixate totally and that which threatens to kill you till it is no longer a threat. IOW, the cigarillos, if they ever were in Browns hands, would have dropped to the ground as Brown put all of his physical and mental effort an that which could kill him.

      Blind rage.

A person in a blind rage will attack another person with lethality till either the other person is down/dead, or the rage subsides

      Who fits that bill?

      Enter Officer Wilson.

    • girlp says:

In his nearly unconscious state he jumped out the suv and started shooting at Michael Brown? This is a bunch of BS.

      • PhillyBoyRoy says:

        It’s like Fogen:

        – beaten to near-death by 20 MMA style death-blows
        – doesn’t do anything about it even though he has hands and a gun
        – waits for more death-blows, starts to get smothered
        – can’t even breathe anymore he’s being smothered and pummeled so much
        – screams bloody murder while not being able to breathe
        – finally decides to shoot his attacker, while standing on the edge of death’s door

        YEAH. Right!

  23. MDX says:

So Brown was able to grab the gun to the point where he had Wilson, who has both hands to use, pinned, such that he could pass off the cigarillos to Johnson?

And he was then able to hit the right side of Wilsons face with his left?

For that, Wilson would have to at least 90 degrees to his left.

And he was hit so hard he almost was “light outs” yet can remember clear details about fingers and gun positions.

Yep, they “crafted” a tale by consulting with lawyers after all the known details that might trip them up got made public.

This is why there should be a police report ASAP.

And we are supposed to trust the criminal justice system?

    • PhillyBoyRoy says:

Makes you sick that people are thrown in jail or executed for false confessions and the like yet known killers like Zimmerman and Wilson can get off by gaming the system.

Source: Darren Wilson Testified Of Nearly Losing Consciousness From ‘Incredibly Strong’ Blows of Mike Brown
More information is being leaked from the Grand Jury investigation against Darren Wilson in the death of Mike Brown that caused Ferguson, Missouri to explode in protests against police.

    From the St. Louis Tribune:

    WILSON’S STORY

After he finished with a call for a sick baby, Wilson said, he spotted Brown and his friend, Dorian Johnson, walking down the middle of Canfield Drive, with traffic passing on both sides.

Wilson asked or ordered the men to move to the sidewalk, said the source, who did not want to be identified because a St. Louis County grand jury and the Department of Justice are still investigating.

Johnson pointed out the pair’s destination, over and behind Wilson’s marked police Chevrolet Tahoe SUV, and kept walking.

Brown walked by holding cigarillos in his hand, and cursed Wilson, the source said.

Wilson told investigators that after Brown passed by, Wilson realized that Johnson’s clothing matched a recent radio alert about a suspect in a robbery at a nearby market where cigarillos had been taken. Wilson radioed for assistance and backed up his SUV to Brown and Johnson.

The source said Wilson told investigators he had placed the SUV in park. When Wilson tried to get out of the SUV, Brown slammed its door shut and punched Wilson in the left side of the face through the open window, the source said.
Wilson, trapped in the front seat, couldn’t use his pepper spray in the confined space because it would incapacitate him as well. His baton was at the back of his utility belt, where he was essentially sitting on it. He did not have a Taser. So he drew his gun.

Brown grabbed the pistol using his right hand, with his elbow against Wilson. Wilson described Brown as incredibly strong, the source said.

During the struggle, Brown handed the cigarillos to Johnson, then swung his left hand and hit Wilson on the right side of the face. Wilson said he almost lost consciousness, the source said. Brown then began to use his left hand in the struggle for the gun, and turned the pistol until the barrel was against Wilson’s hip.

Wilson positioned his finger to try to prevent Brown from reaching the trigger. When Wilson pulled himself back toward the passenger side of the SUV, Brown’s grip loosened enough for Wilson to try to pull the trigger, the source said.

But the gun didn’t fire. Wilson said he believed that Brown’s hand may have been on the hammer, preventing it from moving, the source said.

The second time Wilson pulled the trigger, the gun did fire. Wilson told investigators he thought the bullet had struck Brown in the hand, the source said. Broken window glass was everywhere, and blood was on the door, the gun and Wilson’s hands. At the time, Wilson said, he wasn’t sure whose blood it was.

The struggle continued, and Wilson attempted to pull the trigger twice more. The source said Wilson thought Brown’s hand may have interfered again. Wilson was able to fire a second shot, and Brown ran.

Wilson used his radio to report that shots had been fired and ask for additional cars, but during the struggle, his radio had been switched from the Ferguson channel, the source said.

Wilson said he had gotten out of the SUV and chased Brown.

The source said Wilson did not recall yelling or saying anything then, but Brown had stopped and turned.

Wilson said Brown had not had his hands up; his left hand was slightly out, fingers pointing down. His right hand was grasping his shirt. Then, Wilson told investigators, Brown began running toward him.

Wilson said he had yelled for Brown to stop, then fired, the source said. Brown flinched as if he was hit, and Wilson said he had stopped shooting. Brown continued running toward him, and Wilson said he had fired several more shots. The source said that Wilson had recalled that Brown’s head was down when the last shot hit him there.

When Brown fell to the ground, his forward momentum caused his feet to fly up, Wilson said.

Wilson then made another radio call, for an ambulance.

Later, Wilson drove himself to the police station and was taken to the hospital by other officers. Wilson said he had bruises on the left and right sides of his face and scratches on his neck, the source said. He had no broken bones.

The account was called “nonsense” by the lawyer for the Brown family.

    • PhillyBoyRoy says:

Amazingly he remembers all this stuff now, but couldn’t fill out a report.

      Funny!

Also, notice how he’s back to using the debunked cigarello story. “They looked like suspects of a cigar theft who were reported over radio”. Yep. Mighty fine detective work there, Mr. “I kill kids” Wilson! You cracked the case!

I also like Shaun King. Sadly, Daily Kos has to many racist liberal whites who act like they are “oh so objective” that their shit don’t stink. So I refuse to join because I would not last long till I let one have it.

His are good; you may want to read Black Kos and Support the Dream defenders.

There are plenty of people to beat back the racist trolls. Liberalism is not a solution for white supremacy and/or racism, unfortunately.

        • MDX says:

Daily Kos is loaded with white liberals, many of whom, due to the sense of self-importance they get from being white, educated, well-off, and comfortably ensconced in “good people” land, can not admit they no not a whit about how the other half lives. But because they feel a sense of superiority, feel they can lecture the other half about how it is and what to do about it.

Sadly, all too many Liberals are the Great White Father who feels he needs to help the brown children.

I have a different philosophy. I feel that environment makes or breaks a man and, as a result, no man know an environment better than one who survives. So far be it for me to ever lecture a black person on how it is to “be black” or to survive hard times.

BTW, I enjoy how Chauncey Vega pisses some of the piss ants off.

  31. PhillyBoyRoy says:

There are four “progressive” sites that I visit daily that I will no longer read.

  33. Malisha says:

So predictable, that none of the real evidence is being used in the creation of pro-murderer noise. An autopsy report telling a little story about the progress of an event that the ME did not witness? OMG!!

  35. girlp says:

Lawrence O’Donnell warned that this would happen, this is why an incident report was not filed….so transparent.

  36. MDX says:

It gets worse if you read the link from Wilson’s self-serving jury transcript.

The “incredibly strong” Brown was able to bend back the gun such that at one point it pointed Wilson’s hip.

Oh, and like Zimmerman, Wilson add more drama with a tale about how Mike was able to foil a first shot by jamming his finger in the trigger of the gun.

IMO, they took in all the evidence to carefully craft a lie that fits well.

Don’t be surprised if they found some of Mike’s tissue on the gun and will use that to “prove” the finger jamming of the trigger.

A bullet through a hand at close range is going to splatter blood and tissue all over the place.

The medical examiner making specific conclusions is an unethical piece of shit.

All that can be proved by the blood is that Mike was shot in the hand at close range – nothing more, nothing less.

It can not prove that Mike grabbed the gun.

For example, Mike, upon being startled to see a gun trained to his face, might have reflexively threw his hand up and it was shot at close range.

Or I could come up with many more scenarios equally probable to gun grabbing.

And Wilson’s testimony is by a person with a vested interest not to tell the truth, if the truth indicts him.

So what he states vs. what Dorian Johnsons states should be given, at least, equal value, taken alone.

However, I would give Johnson’s testimony more value because it correlates well with other testimony and the taped shot sequence.

PS, I forgot the other Wilson whopper.

He claims that the struggle was so hard and violent that he almost passed out.

Kind of reminds me of these Zimmerlies:

“I was choking to death on my own blood”

“my head was about to explode”

“He pressed his hand so hard on my face, that I could not scream”**

**note that Mr ‘Nam Medic was able to whitesplain this to a jury to prove Zimmy was screaming because it is a well known fact that the hand of a person of African decent, although it can mask screams locally, acts as a sonic transmitter to relay them to more remote receivers.

Sorry for the rant but, right now, I am pissed and ashamed to be an American. The whole world is watching this BS and I do not like to see my nation make a collective ass out of itself.

    • PhillyBoyRoy says:

The media should call this out.

Cops should be held to a higher standard than the average joe, not one that’s much much lower.

I’m about as pissed as you. I’m at a breaking point honestly.

  37. LLMPapa says:

Would love to hear a logical explanation of how a bullet could enter an arm’s upper ventral (underside) and exit the dorsal (topside) unless the arm was raised with the ventral side facing the shooter.

    • MDX says:

Possibly if Brown was being shot as he was running away. Humans tend to run with top side of their arms facing forward.

Of course, what I just wrote would not help Wilsons’s tall tale, no would it?

I listened to that tape and feel the first series of shots include some as Brown was fleeing and Wilson was chasing.

And that would match what witnesses described.

  38. LLMPapa says:

Read Items #6 thru #9 of the Autopsy then watch this for a witness account:

    • MDX says:

Exactly, a person shot goes into shock and crumples down. That medical examiner making conclusions is unethical and, frankly, if not a liar, stupid. Logic dictates that a person subject to a series of shots will progressively weaken to the point of shock wherein a reasonable conclusion is that Brown was not able to raise his arms high because a circulatory system with massive pressure loss sue to being “holed” can not pump arm blood high. It is simple physics. And it is quite unreasonable to conclude that a person crumpling in shock due to repeated bullet hits would be able to support the acts of “Bull Rushing” or “lunging”.

Critical thinking skills, in light of the Zimmerman case, and now this developing farce do not exist in the USA.

The right wingers get a bye because they do it on purpose. My ire is directed to those on progressive or middle road sites who accept this BS.

      • PhillyBoyRoy says:

The cops should recruit bull rushing blacks to the force. Apparently they can withstand a barrage of bullets and keep bull rushing. They’re animals.

        • MDX says:

That is the underlying logic that either internalized or overt racists believe and, because it is so rampant, will set Wilson free.

I will start with a rational human.

What are the odds of a human trying to take a cops gun knowing full well that such an act means death or a very long stint in prison?

I would say at most 1/1000

What are the odds that a rational human, after being shot, with the flight response in full mode, suddenly trying to attack again?

I would say at most 1/1000

What are the odd of a rational human, when unable to run well due to no shoes on their feet, having been shot at least twice, and being under a hail of fire, deciding to try and surrender?

I would say greater than 90%.

          A wild animal

What are the odds of a wild animal deciding to attack?

          Greater than 50%

What are the odds of a wild animal bolting after being struck by a shot?

          Greater than 90%

What are the odds of a wounded wild animal making another desperate attack?

          Greater than 50%

So how one interprets this event tells me all I need to know about who is racist in post-racial USA.

I pulled the odds out of my ass but feel they are not that far off of the mark to make a point.

          • PhillyBoyRoy says:

            Great points, all.

It just dawned on me that, if 90-95% of folks would surrender to avert certain death under the assumption that a cop wouldn’t shoot someone in the face who is surrendering, especially after they just shot them multiple times anyway, most of the other 5-10% would simply succumb to their injuries either physically or mentally,

One scenario that I don’t rule out is that Michael Brown just gave up running after having been shot twice (once in the car, once more in the back), and facing what probably seemed like an endless barrage of bullets from Darren “Depraved Racist” Wilson.

Another scenario: he’s disoriented and and in pain and can’t surrender.

Another; he’s been hit two times and can sense he’s going down: this crazy white racist ain’t gonna stop until he’s emptied his clip, and preferably into a black. So maybe poor Michael knew his demise was imminent and wanted to face his racist executioner.

            So what?

EVEN IF YOU BUY THE BULL RUSH LIE, you’d still have to think a trained, non-psychopathic, even slightly racist cop would simply say – to a severely wounded teen who probably wasn’t moving all that fast – “don’t move or I’ll shoot”, train the gun on him, and wait for his next move… Not go for kill shots through the head.

            BUT

Since Wilson is racist scum, he did exactly that.

And since the country is full of racist scum, he is about to walk, not having been tried by a jury.

  39. sparger says:

I don’t think the average person in this country has critical thinking skills. Anyone falling this case knows something happened at the car. They know Dorian Johnson said a shot was fired when Brown was at the car. Then he was a liar and making shit up because he was a no good lying liar high on the drugs thug. All the other witnesses were liars and they are still liars except for the part when they agree with whatever narrative they are pushing. They are all stuck on the episode at the car and don’t care about the shots fired from more than 90 feet away.

That San Francisco ME should be ashamed of herself for saying Brown tried to take the gun from Wilson. She is just speculating based on a report she read.

  40. Motor City Lady says:

I’m curious about the apparent discrepancy between the autopsy findings and a later analysis of skin taken from Michael Brown’s thumb, which was injured by a gunshot wound.

In the post-mortem examination report, all of the gunshot entry wounds have the notation: “No powder stipple is identified.”

In other words, upon gross examination, the graze wound on Brown’s thumb did not appear to have any stippling.

But why, then, would tissue from that wound later be submitted for further analysis, which just happened to reveal that yes, in fact the wound did exhibit powder stippling?

Was tissue from all the entry wounds exised and sent for further analysis, or just the tissue from the thumb graze wound?

There is no date on the supplemental microscopic report to indicate how many days had passed between the post-mortem exam performed on August 10, the morning after Brown was killed, and the microscopic analysis of the tissue that revealed the stippling.

Additionally, I recall that Dr. Baden’s autopsy concurred with the original findings of the County Medical Examiner: no stippling around any of the entry wounds.

  41. shelleyjust says:

    Thank you for writing this.

And thank the commenters for also mentioning the possibilities that somehow the mainstream media can’t seem to mention on their own.

Funny how no one asks Darren Wilson’s height and weight.

  42. racerrodig says:

Right…..the gun fell out of it’s holster. I posted some things on your previous blog about this Prof.

One important issue is that the SUV is higher off the ground than a car. That would make it pretty much impossible for Mike, even being tall to even attempt to reach across the killers body.

Wilson is also a big guy and that is not being mentioned at all.

It can be argued that Mike was being pulled by Wilson, and Mike was pushing back to escape, maybe he was pushing on Wilson or maybe the steering wheel, maybe the door frame, maybe the steering column ?? It seems there are more maybe’s than anything. To claim that Mike had to be going for anything, especially a gun, insults the intelligence everyone who isn’t a racist with an agenda.

    • PhillyBoyRoy says:

Honestly even if his story is 100% true – it’s 100% false but let’s just pretend for the sake of argument – he’s still guilty of murder. You can’t instigate a confrontation, then claim you were in fear of your life (I mean think about it, there’s is literally ZERO LOGIC to that), and THEN kill someone “in self defense” after they’ve retreated.

      What is this, Florida?

  43. Bill Taylor says:

what about how one writer put the story “the gun UNholstered” then later the “gun fired” that is one incredible gun there wilson just sat by while the gun DID everything for him it unholstered itself and then FIRED all by itself.

    • Motor City Lady says:

Bill Taylor, both those “passive voice” descriptions came directly from the Narrative Report of Investigation, prefacing the autopsy report, submitted by Medicolegal Examiner, Wendell Payne.

His narrative report is based on secondhand information from another officer, Det. Hokamp of the St. Louis County PD, who presumably interviewed Officer Wilson and then relayed to Payne what Wilson told him, at the scene.

This is as close as the public has gotten, yet, to an incident report from Wilson.

    • girlp says:

I thought there’s a release mechanism to unholster an officer’s gun? He had to have had his gun out when he grabbed Michael.

  44. Two sides to a story says:

No one randomly goes after a cop’s gun through a car door or window. The only scenario in which a person would do so, realistically, is if protecting themselves from a cop with a brandished weapon.

I can’t post this enough man!! This isn’t unbelievable. They get away with this all the time

    http://m.youtube.com/watch?v=T4HUvXOvgkQ

I just want people to remember that these cops and their union leader lie and obstruct to protect their own. There is no way to make me believe they didn’t do it with Mike Brown

  46. Bill Taylor says:

and since when is the standard surrender position hands as far as possible over your head with the palms facing OUT? that lady lacks the intelligence to understand she made a fool of herself…..and seriously a person shot in the arm 4 times MAY not be able to raise it high enough to satisfy that stupid ladies desire of reach for the sky!

    • MDX says:

Agree. See my post about shock and loss of blood pressure below.

It take a sound circulatory system to keep hands up high because the heart has to pump blood to a higher elevation. And, unlike the legs, their are no check valves in the veins.

And I would think a sound ME should know all this to a T.

  47. Professor, you hit all of the salient points. But, unfortunately, I feel like we are whistling in the wind. The Post-Dispatch stopped responding to my concerns weeks ago and the P-D reporters continue to churn out tripe.

  48. Sophia33 says:

I got in trouble for saying this during the Zimmerman trial..but being black in America has given me several PhD’s in the treatment blacks receive in the judicial system…the fix is in. Yes, they are making a story around the evidence. When I saw Don Lemon backtracking a few days ago, by saying that this was never clear cut and that there are witnesses that say MB bum rushed Wilson, I knew that they are trying to prepare us for this guy no being indicted. Not one media outlet has said that this supports Dorian Johnson’s view of the events. And it does. If someone were trying to shoot you at close range, wouldn’t you futilely try to block or grab the gun? But the real issue is what happened outside of the car. So now they are saying that the eyewitnesses were wrong. Black witnesses can’t be trusted. And what about the two white guys, who weren’t from Ferguson, who were video-tapped saying and showing that MB’s hands were up? No one is talking about them anymore.

    • Bill Taylor says:

your post makes far too much sense, any person being held and looking into the barrel of a gun would just NOT use their free hand to try to block the shot by hitting the gun to move it away from their head…..they would obviously sit and accept the bullet about to be fired……..after all them black folks they LIKE getting shot that lead just makes them stronger.

    • girlp says:

The statement made by the alleged witness that favors Darren Wilson had Michaels arms straight out rather than up, I don’t know what they gave him to cause this witness to lie but they did something for him.

    • PhillyBoyRoy says:

There’s no yelling on the Skype call as Wilson claims. It’s a lie.

His version is a nonsensical Hollywood version of a struggle between good vs evil, lots of shouting and drama; what actually transcribed was quick and dirty.

      – angry racist cop tries to strong arm kids in street because black
      – they resist especially when said cop tries to grab them
      – a shot is fired during the struggle and the kids flee in fear as a result
      – shortly thereafter the cop empties the rest of the clip as the kids run

There was no yelling and high stakes life-or-death struggle for the gun. It happened quickly and the kid was executed.

    • That would be my guess. For those unfamiliar with the name, Jeff Roorda is a former police chief of a nearby St. Louis municipality who was dismissed for falsifying reports. He is now head of the St. Louis police union, a state rep and is running for state senator.

      • shyloh says:

This does not surprise me. We have a chief of police that was busted smoking and selling meth 4 years ago. You guessed it, he’s still the chief of police. UGH!
