Good morning:

We continue the Wafer trial today with the testimony of David Balash and possibly the testimony of Theodore Wafer.

Unfortunately, we have to follow it on twitter because there is no live coverage.

UPDATE:

Wafer testified today. You can read tweets of his direct and cross in the comments below.

Most of his cross today has involved playing his interview at the police station. The cross will continue tomorrow at 9 am.

Wafer never asked who she was or why she was there before he shot her.

      wafer admits to manslaughter in his own words during his testimony. this prosecution team has been diligent, expect them to drive that fact home during closing arguments. also, wafer’s experts were mediocre at best, sometimes downright dismal for him.

      cross your fingers and hope for the best, but wafer has admitted to manslaughter, do not forget that.

    If you threaten someone with an empty gun you better pray that they don’t have a loaded one because they will have a reasonable belief that you represent an imminent threat of death and can act accordingly.

      amen! it’s a dumb thing to do which is why i say he is either an idiot or is lying about not knowing the gun was loaded. either way, his own testimony should be enough for a ‘normal’ jury to put him behind bars for sometime and make it illegal for him to have a firearm for the rest of his life.

      anyone that careless with a gun who panics as easy as he does, ought not be owning firearms.

    He said he didn’t want to cower or be a victim, but he never mentions looking for shells. He just grabbed the shotgun. He was back against the kitchen sink, the windows were rattling, floor vibrating, it was more and more violent – but he never went to look for shells. He opens the door, someone comes from the side real fast and he shoots.

    There are some things you do because you already have inherent knowledge that is a basis for your later actions, a foundation. Sometimes referred to as a “given”. Later actions can expose them, working backwards, because the later actions are not “reasonable”, unless they are based on these “givens”.

    He’s lying. He knew full well the gun was loaded. It was given that the gun was loaded, else there is no reason to stand with your back to the kitchen sink while your home is under attack, without looking for your ammunition, if you believe your gun is unloaded. It makes no sense to open the door and pull the trigger, if you believe your gun is unloaded. If you think to scare someone away with an unloaded gun, you point it at them and say “stop or I’ll shoot”. You don’t pull the trigger. It defeats the purpose of scaring them to let them know the gun is unloaded. The only reason to pull the trigger is if you inherently know the gun is loaded.

    The pros. seems to have asked a lot of questions about the whereabouts of the cell phone. There doesn’t seem to be any indication that they asked him, “Why, if you thought the gun was unloaded, did you not bother to look for your ammunition?” IJS

      They also need to ask him if he was taking any prescription or over the counter drugs that night… Again, if he was fearful and so afraid because he though there were several people attacking his home, why immediately after he murdered Mz. McBride did he lay the shotgun down on the floor with the door still open and leave to find his cell phone? I actually suspect he had his cell phone with him at the time of the murder… His story is full of holes and not even remotely realistic for someone who is so fearful for his life… I think the pros need to ask a little more about how much he had to drink and his prior history with anger issues when drinking….

        He seems to be wearing his jeans in the police interview room. I thought he got up at 12:30 or so and change to his nightwear? Cops let him get out of his PJs before taking him in? His charger was right next to where he was sleeping in the chair too. I too believe he had his cell phone already, as well as his jeans on.

      Dave, I’ve been gone most of the day and just now reading and watching. Did you notice he held the pistol grip in his left hand and just like I outlined? Three beers? Yeah sure were the 64 oz beers? He admitted to being mad just like I surmised… I’ll say it again he shot her out of anger not even know who it was… Did you also catch immediately after the shot, he placed the gun on the floor, this is the man who though there were multiple people beating on his house and he lays down the gun?       sums up my thoughts on the issue … but i think we all know what ‘three beers’ means. he was an idiot for not checking if the gun was loaded (or lying), he was an idiot for opening his own front door. he has basically admitted to manslaughter right there on the witness stand. i don’t find his claims of 2-3 other people credible either, although i do not doubt he was scared out of his mind.

            i may have a different take on this case than others, but i do not sense open racial animosity on the behalf of wafer. i do see the defense doing it’s best to instill it in the jury, however.

            wafer strikes me as a human who through a series of very bad decisions from drinking to opening that front door to shooting. i really do not doubt that he experiences remorse, but that would only help him in sentencing. what he is describing on the stand is straight up manslaughter.

    Do you think jurors told not to research or look at anything about a case follow those instructions? Sometimes hear jurors admitting to it and are released. I usually think it because it’s an easy way to get removed if person wants off jury.

      god only knows, J4. i would like to believe that all jurors take their responsibilities seriously, but i am jaded enough to suspect that not all do. if they never admit to it, then it will never be known.
