Our commitment to this blog

Thursday, January 30, 2014

Good afternoon:

Many of our readers generally know that Crane and I have enemies dedicated to intimidating us and eliminating our blog. I write today to describe their tactics so that readers will recognize their handiwork when they see it and better appreciate what we deal with on a daily basis.

To discredit what I say, they knowingly disseminate false and malicious information about me and my professional reputation as a lawyer and law professor. They do this at their own websites and at high-traffic internet websites like the Huffington Post.

They do not rely on real evidence because no such evidence exists. As my regular readers know, my posts are self-authenticating for the most part because I explain what is happening in non-technical language, provide insights about a case or issue that only a knowledgeable and experienced trial lawyer would know, and generally predict outcomes accurately or explain what went wrong. I admit I am wrong when I make mistakes.

Over time the truth of these statements reveals itself.

Our detractors attempt to create the appearance that their false statements about us and what we say are legitimate by using multiple internet identities to communicate the same false information and proxy servers that conceal their true identities and IP addresses. Using this method, one person can appear to be more than ten people having a conversation about us or something that we supposedly said.

This method of character assassination and legitimization of false information has been around for a long time. The late Andrew Breitbart used it to discredit democratic candidates for political office and organizations dedicated to registering voters and turning out the vote. The method was used to defeat John Kerry in the 2004 election. At that time it was called swift boating.

In some cases involving people who have their own blogs and comment here, they have threatened to use the same tactic against them unless they moderate what they say and stop commenting here.

The effort against me has been underway for about two years and I have no reason to believe that it will end unless the feds indict the people running the scam with conspiracy to violate my civil rights.

Everyone has a right to free speech, including me. However, it is not absolute. For example, no one has a right to scream “Fire” in a crowded theater.

The right to free speech comes with a duty to speak the truth. Knowingly or recklessly uttering false statements about another person is not protected by the First Amendment. If such a statement causes an injury to a person’s reputation that is capable of being measured in dollars, such as lost income for example, the injured person can recover money damages from the person who uttered the false statement.

Under some circumstances, a person who utters a false statement may be charged with a crime.

We realize that a federal prosecution against the people attempting to destroy the credibility of this website probably will remain a low priority for the feds, unless someone is murdered. We are not the only people whom the right wing hate machine seeks to discredit and silence with a coordinated campaign of lies.

They do this all the time.

From time to time we get discouraged by all of the hate directed at us. Within the past two weeks we were doxed: our address and telephone number was published on the internet.

We want our readers to know that we honor our commitments.

No matter what happens, we will continue to speak the truth.

George Zimmerman would have never walked away from this case had the prosecutors not made the case a racial issue. There’s no way to win using race in the state of Florida. They just don’t have the education or the guts (or jury pool) to go there. Had the State used GZ’s past violent history and propensity to fight, his stalking of ex-girlfriends, his harassment of others (such as his landlord), etc. that jury would have been more than glad to convict him.
But had they convicted GZ, they would have convicted the entire state of Florida because they chose not to arrest him in the first place.
    Enough said.
The problem now is that since his acquittal, he actually believes he’s a celebrity and unfortunately there are enough racists in this country to rub his ego and make him believe he is special. He’s not, he’s piss ant who would have never amounted to anything.
How do we stop it? Anyone know?

Well-stated! And for the detractors…nay nee nay nee boo boo!

Professor, just posted this to address the harassers’ new agenda.

I’ve read a couple of blog posts recently. I’ll be glad to forward them to you.

We have your back Prof and Crane Station. Keep fighting the good fight.

Trayvon’s birthday is coming up and a year since he was murdered. Kisses to Heaven.

Have you guys heard, TMZ is reporting that Fogen has issued a challenge to fight any celebrity and even any black person to a fight. for someone who is suppose to be soft, why would he do that? TMZ and all of the other media need to stop playing his BS games because, they are giving him the false impression that he is a celebrity for murdering a child.

    • Rachael says:

He would do it because he is guilty, he knows he is guilty, and this is his way of “confessing.” He is a very sick young man.

    • MDH says:

It is an incontrovertible fact that George’s acquittal was based on accepting that he was a wimp and coward who needed a gun to defend himself against an unarmed 150lbs teen.

That fact is eating at George.

So he is trying to save his cowards face.

So he seeks a staged fight wherein he can say he took on a big dude, knowing full well his life can be saved by the bell or a referee.

      No George, that won’t work.

The brave person took on the larger man with a gun, knowing full well there was nobody out there to save him.

And nothing in this world that George does will ever change that fact.

Fred, that sure is deplorable about those who work to defame others, or just to be a-holes and trolls…

Fred, I took one snippet: [” Everyone has a right to free speech, including me. However, it is not absolute. For example, no one has a right to scream “Fire” in a crowded theater.”]

Well that is an old one!, and I thought: Gee, Fred is in a bad mood, like I am too. Well, me thought: make a joke, ’cause humor is a good antidote… etc.

Here is the joke: “If somebody yelled Fire! in an empty theater…

    “Did anybody hear it?”

    Keep up Keepin on Fred.

foggage put TRAYVON In a box.

  8. i’m not sure what has been going on as far as detractors but i trust that this site is always fair and informative. Other sites sicken me. Keep fighting the good fight!.

As for george and boxing, lets hope he doesn’t pull a gun on his opponent when he fears for his safety…after all what’s the difference. He is going into a fight knowingly and might get hurt, when he chose to get out and follow someone he thought he was a threat he knew he might get hurt then too, but did so because he had a gun to fight his fight for him. He chooses to put himself in harms way and then takes the cowards way out. For Trayvons sake I hope Mike Tyson is the highest bidder.

  9. Brandy says:

GZ bragging about his boxing skills. hmmm, thought the defense said in the trial he was a wimp and a softy. Hope this backfires on him bigtime! Oh well, only in America.

  10. Two sides to a story says:

David Piercy – usually calling himself Just Plain Dave or Creepy Ass Cracker as of late, is one of your loudest detractors, but there are probably others who remain in the shadows.

Have courage, stay strong – these cowards will likely always hide behind their screens and will orobably self-destruct one day. While they busily try to get others in trouble for no particular reason other than they dislike your opinions, they too are being monitored.

    • ladystclaire says:

David Piercy’s self destruction is closer than you think! he could have quit while he got out of the gate good but, he’s too mental to know when to leave well enough alone. yep, his time with LE is looming very near.

  11. Brandy says:

Hi All, Just read that Georgie signed up to do a celebrity boxing match. The story and his boxing pic is over on RadarOnline. I feel so disgusted! Hoping he will get his butt kicked ! Why oh Why are they giving this evil man this attention? Our society is so messed up!

  12. Lyn says:

Fred, I am looking forward to your analysis of the Dunn Case. Perhaps with some comparison to the Zimmerman trial.
I think that DOJ is going to take a pass on charging Zimmerman and just has not worked up the courage to be honest with the people.

  13. lairdbearly says:

I am planning to donate some $ when I get SSI payment on this Saturday! What is your prediction about DOJ’s action regarding GZ/TM case
