Marlise Munoz hearing

Good afternoon:

No live stream of the Munoz hearing and it started at 3 pm. Judge ordered all cell phones turned off during the hearing, so no one can tweet about it.

Two hours before the hearing, the hospital acknowledged in legal papers filed with the court that Marlise Munoz has been brain dead since November 28th and the fetus is not viable.

    fogen is such a dunce. It’s true that Angela Corey has little respect for the justice system but I don’t understand why fogen would attack her for it. After all, she is the one who orchestrated the prosecution in such a way that he achieved so much notoriety and walked after killing and lying about it.

    We have been out much of the day today (Saturday), and we are back. We have one more thing to do and then we will be back here, at the site. Should be another hour, give or take!

  3. George Zimmerman’s exact whereabouts are unknown, and an email address and phone number for him could not be found. His brother, who has frequently served as his spokesman, did not immediately respond to an email.

    On Twitter, George Zimmerman wrote Friday evening: “No worries AP, I’ll just take whatever U sue me for off your tab when I’m done suing you πŸ™‚ Or… I could put out how much U offered me 2..”

    Responding to Zimmerman’s tweet, Colford, the AP spokesman, said: “We don’t know what he’s talking about.”

      He is just feeding the lemmings. Everyone keeps telling him how he should sue everyone under the sun and this just makes them feel like he is. He could easily stop the comments on twitter by going private but he is the type of person who likes to “throw bombs” and then sit back and watch the reaction for fun. He rarely comments back to anyone after the bomb is thrown. He posts things just for his amusement of watching others react. I used to work with someone like that and it is truly a sick mind if you think about it.

      Well, it appears that CAC has ACTUAL notice of AP’s ownership claim and cease and desist warning. Not sure that’s a substitute for LEGAL notice, but maybe could affect damages if he proceeds with any marketing efforts (?).

    • can’t believe he’s on twitter. I just had a look and he is encouraging a 16 year old to fight for him, being an immature dick arguing with people, making threats like “give me your address and we’ll hash this out” etc. Shellie was spot on, this guy is loving it and way to cocky for his own good, and that of the public.

    • Some things are easy to figure out.

      The AP has no sense of humor about this sort of thing.

      Should be interesting to watch.

      Shepard Fairey used an AP photograph to create the Obama Hope poster and ended up settling AP’s lawsuit against him for copyright infringement for $1.6 M.

      It’s easy to do. Copy the digitized photo into Photoshop or similar program, run a filter to remove most of the detail, print, project, paint using only I’ve used the technique to do a portrait using fabric, although I kept more detail than fogen. He used only 3 values and I suspect the painting was enhanced by his teacher. Many teachers want their students to produce “good” stuff so they end up doing much of the painting.

  6. The case is not over yet.

    The Tarrant County District Attorney’s Office is representing the hospital and it has until Monday afternoon at 5 pm to file an appeal and obtain a stay of the judge’s order pending an appeal.

    Whether he will appeal and, if he does, whether the appellate court will issue a stay is unknown at this time.

    Stay tuned.

    • Surely there will not be an appeal.

      What am I saying. If they could pass a law to dig up corpses and hook them to machines, they would. And they’d call it ‘living.’

      Maybe that sounds harsh, but I just…this case has been heartbreaking.

    The judge ruled that the Texas statute does not apply because Marlise Munoz is dead and therefore not a “patient.”

    He did not reach the constitutional issues.

    What torture they put that family through! If that foetus had really been a child, it would have been Mr. Munoz’s child and he would have wanted very much to save it. It was NOT a child! Everything’s completely upside down to force a dead body to try to nourish a neoplasm that is totally dependent upon its LIVING processes to survive!

    • Thing is too, how much additional suffering was caused here. For instance, hydrocephalus – is that condition not associated with extreme pain?

      I could be wrong, maybe a neonatologist has more information on this.

      Wondering also, will there be an autopsy? Just wondering out loud, because I am not sure there is consensus on the pulmonary embolism. I think that was only a theory.

        My son who passed had hydrocephalus. We found out in week 33 and he was delivered asap. The fluid in his brain left no room for brain development so he basically had just a paper thin line of brain matter and a brain stem. Developmentally he was age zero when he died. He could not walk, talk, hold his head upright, nor vocalize.
        If I were to have knowledge upfront that my child was not viable in any way, i would have terminated. Back then you didn’t have all the ultrasounds and tests like today. I only found out when I went into preterm labor because of polyhydramnios. (Too much amniotic fluid.) I had too much because my child wasn’t swallowing the fluid like a normal developing baby.

    The way I read this retweet, the Texas Medical Assoc may not be happy w/Texas ledge practicing medicine.

    • IIRC, 37 states passed similar legislation, so it’s time to go to work and repeal those statutes so this does not happen again.

        i would think this is a supreme court issue. it creates a second class of citizens, i.e., pregnant women whose DNRs or medical PoAs are illegimate according to state law IF she is pregnant.

        mind you, i would like to see on of our conservative justices retire first.

        With increasing frequency legislators are practicing medicine without a license by mandating procedures without knowledge of the circumstances and superseding the patients and doctors who should know better than the empty suits. This needs to stop.

  26. Reading between the lines, I think the hospital is willing to pull the plug, if the judge will issue the order.
