Bernie de la Rionda delivers State’s Closing Argument in Zimmerman trial

Good afternoon:

The conference regarding jury instructions is over.

Court is in recess and will reconvene at 1 pm, EDT.

With one exception, Judge Nelson has selected a set of instructions.

The exception concerns whether she should include an instruction on 3rd degree murder. The defense objects to the instruction because they do not want the jury to be instructed on any lesser included offenses.

However, the Florida Supreme Court requires her to instruct the jury on all lesser included offenses and she has already agreed to instruct on manslaughter. Third degree murder is a lesser included offense. Therefore, she also has to give the instruction.

Defense argues that the instruction conflicts with their theory of self-defense and the predicate felony (child abuse) is incendiary.

Too bad. So sad. But don’t kill a child. Trayvon Martin was a child because he was only 17-years-old. killing a 17-year-old person is an extreme form of child abuse.

She has to give the instruction and the defense is going to have to deal with it.

After she announces her decision about this one remaining issue, the final set of instructions will be completed and read to the jury.

Then Bernie de la Rionda will deliver his closing argument to the jury.

His argument is the State’s opening closing argument. John Guy will deliver the rebuttal after Mark O’Mara deliver’s the defendant’s closing argument tomorrow.

    This media is so behind that child killer it is unbelievable. Not ever twelve months ago they were rallying behind him. See what the KKK and White supremacy David Duke group money will pay off in the media and his legal fees. Oh no don’t forget the NRA.. Why did they remind the jurors that Trayvon Martin “saved his father’s life.” He drug his father out of a burning house when he was eight or nine. Does the prosecution know this? tweet this to the Guy so he can use it on rebuttal.

    Listen to this: GZ website it appears is brining in $30,000 a month that is 1/2 of a million a year. He paid for this trial and his “judge” father called in favors. Listen why didn’t they even allow his father to tell what his career has been for years. A “Magistrate Judge.” He is clearly KKK material…

    Check his ruling record…somebody… I’ve asked my associate in the DA office to dig it up if she can…

    GZ has gotten out of everything restraining orders, molesting his cousin, and murder… Find this child murder guilty… now…

      EIEIO~ No, DON’T forget! Use that as a motivation to continue to fight against injustice! This one case is a milestone, but like you said, it’s just one case. We CANNOT stop with just this one case!  SYG should be greatly modified if not struck down altogether!

    Everyone I’ve asked said he was terrible. They are upset. The Chief said Bernie wasn’t in detail enough and people could hear it. I just couldn’t watch it? What does anyone here think?

    I’m being told that the defense is going to wipe out everything he has said. My take on it is everyone of those jurors walked in that box with and opinion of George Zimmerman. And I will never believe they never heard of the case. If they walked in there thinking he is guilty they will vote that way. If they walked in thinking he is innocent they will vote that way. Laughing jurors this is Sanford Florida….

        No need to be sarcastic.. I still feel it is rigged. Bernie is not closing the deal… Tell me what you think Trayvon was thinking when he ran and began screaming the juror needs to know this…. Those defense attorneys clearly can give GZ (murderer) opinion why not Bernie. Guy needs to close this thing fast…. Guy is the thinker on his feet.

        Sanford is a bigoted county whom covers child killers. Once again their wouldn’t even been a prosecution if the nations didn’t rise up….

          EIEIO~ I can only guess what Trayvon was thinking, as could ANY woman or child alone on a dark rainy night. I think Bernie did a good job of making that real. Guy just needs to remind them of that fear, and see that escape was all Trayvon was trying to do. I don’t see how this very public trial could be fixed, unless the jurors were all selected AHEAD of time, and the entire process has been a very expensive charade. gz WILL be found guilty. Can’t say which, but I believe there is MORE  than enough for M2.

    Interesting, the defense timeline.

    Especially interesting that they left out the time of the shot. The jury will notice. Just like they seemingly did not want to give that part of the story too much attention in the video.

    Of course they told the jury at one point that it took w11 20 seconds to connect. Hoping that none of the ladies knows anything about sound and how it spreads. Just believe w11, don’t really care about her name, that she knew which direction it came from.

    Does anyone have the prosecution’s time line. I wonder what that looks like.

    They have the reenactement video, they will be able to check the reliability of Fogen’s tales by taking the time of his return to the t-section. Not bad, thanks defense. How does that fit into your client’s tale?

    I don’t see how fogen can escape a very long prison sentence and within that sentence many long, horrible and miserable days and nights. fogen is evil incarnate.

    I give JN a lot of credit. I think she believes GZ guilty. If I were her I don’t think I could hide the contempt I would feel for despicable criminals such as GZ.

      JN’s belief about the guilt or innocence is not relevant; she is not the decider of fact in the trial since there is a jury. She is the decider of LAW. She has made some legal decisions I found way wrong, some I found way right, some so so, but she has been patient, clear, moderate, polite, and attentive. She has worked very very hard and she has protected the ethical standards of the State of Florida and the rights of the defendant, the state and the jurors. She has avoided all appearance of impropriety and she has avoided personal commentary or peevishness although in many instances the defense counsel were trying hard to push her toward such indiscretions. I am not a big fan of judges in general, and usually consider them petty pompous warlords whose power as utterly corrupted them; I give her high grades for NOT being that way.

        Of course, you are absolutely right. My point was that I, personally, could not function in her capacity and hide any impartiality.

        I worked for years with pompous lawyers and judges (although not in the criminal arena), and I can think of many for whom I had no respect.

    I was worried in the beginning of Bernie’s opening, and he did jump around a lot, but he definitely did a good job overall. Now, MOM will come in tomorrow and try to debunk everything Bernie showed them today and tell the Jury that the State as nothing to prove the charges etc… But we then have the very passionate John Guy to come in and quickly remind the Jury of the key facts, humanize Trayvon and play the screams and gunshot that silenced Trayvon Benjamin Martin forever.

    Now let’s talk about that drawstring on Trayvon’s hoodie…did any of you guys notice that? I thought it was powerful in showing that Fogen was pulling on Trayvon’s shirt before shooting him.

    I have been saying that Zimmerman had that gun out the time he decided to follow Trayvon, because everyone was putting the gun on his hip to the front of his pants. He showed us where the gun was on the right hip side. Which it would have been no way for him to get to it, in the position that he ”claimed” to be in. However, you can look at the blood flow pattern of Zimmerman head and see that Zimmerman was on top of Trayvon as he was bleeding, gravity doesn’t lie.

    Zimmerman caught T by the shirt when he got away from Zimmerman yelling and screaming for someone to help him. He grabbed him by the shirt swinging Trayvon to the ground. And as he still had Trayvon shirt in his hand pulled away from Trayvon body, he ”aimed” and shot him once as he said he did himself. However, he only used the word ”aimed” only once when he was taken this lie or stress test.

      Yes, Fogen could have tried to grab Trayvon, prompting Trayvon to say, “get off” and drop his phone while trying to get away. Fogen chases him so Trayvon starts screaming for help, Fogen then grabs his shirt and they fall with Trayvon on top, Fogen hits his head on the concrete keeping a hold of Trayvons shirt while Trayvon is trying to get up screaming for someone to help him. Maybe and I mean maybe, Trayvon hits Fogen in the nose trying to get away, Fogen then shoots Trayvon while he is still holding on to Trayvons shirt.

      This explains why there are no defensive wounds…Fogens hands were too busy holding Trayvons shirt with one and holding the gun in the other.

    I thought BDLR did a fantastic job. I thought his tone was rough when it needed to be and was gentle when it need to be.

    The Killer has told so many lies that there was no way anyone could put them all together in one neat little package — I’m just glad BDLR pointed out all of those lies.

    The Killer had
    – about 5 different lies on how he came to search for Trayvon
    – about 4 different lies on what Trayvon was doing before he ran away from the killer
    – about 10 different lies on why he continued to search for Trayvon
    – about 5 different lies on how he was allegedly punched by Trayvon
    – about 6 or 7 different lies on how he shot Trayvon
    … and the list goes on

    With that many lies, the only way to ‘package’ them is to list them.

    Like Bernie said Trayvon speaks to us from the dead through the forensic evidence. That is powerful because it is true. Unfortunately he could not be here because as he said the defendant made sure of that. Made sure he could not tell his side of the story. A good point brought up is that if the defendant says he was going for his phone, perhaps maybe going for his gun. So if we think about those last moments heard by Rachel Jeantel she says the defendant asks him “What are you doing around here.” Trayvon says “Why are you following me” Then she says Trayvon is telling him to get off, could it be at that point he was going for his weapon while clutching Trayvon’s hoodie so he couldnt get away and they fall to the ground. Then according to Bernie that is where John Good’s perspective comes in because he could not see the defendant’s hands. Could it be Trayvon was trying to get his hands away and push himself up. He is yelling for help because this guy already had is gun unholstered and ready to fire.

    I really don’t like Bernie’s presentation. While it had a lot of good points, it was also disjointed. I also don’t like being bullied and this was his tone. Appealing to the intellect with a calm voice is soooo much better than battering with shouting. Now it’s down to the final hope, John Guy.

      In discussions about what is admissible in the closings, the subject of payment came up. Defence didn’t want prosecution to say anything like witnesses were “p[aid off”. (This was when Judge Nelson said some sounded like infomercials).

      West said Dr Di Maio didn’t say how much he’d been paid, only “how much he charges”

      Oh-oh. So they’ve not paid him yet? or they got some sweetheart deal from him?

      Most of the scream-recognition friends seem to have paid for the privilege of their 15 minutes of fame, by donating thousands to GZ’s lifestyle.

      Talking heads on CNN touched on it… they claim that it could be baiting the judge into saying something biased so that they can use it for an appeal issue. They have shown that they are sharks when it comes to that, recusing two prior judges. JN is not taking the bait and she even gives them some leadway.

      I wrote a 150-page paper on the “mainstreaming of delusion” over Obama’s first term (mainly focused on the Tea Party and things like “death panels” and “FEMA concentration camps” and birtherism), and how it took over the far and even moderate right. Ultimately, they began to operate in their own reality and even had their own facts, such as completely unscientific “unskewed” polls, and the Romney internal polling that was based on outdated turnout data. What drew me to this case, aside from my outrage, was this same kind of “thinking” happening among GZ supporters. So yes, you’re dead on.

          I am a sociologist. I researched this over four years. I know U.S. politics inside-out. I can write on whatever I want. My paper largely dealt with new phenomenological and ontological perspectives drawing both on existing social theory and was evidence-based. This paper passed peer review without revision.         Also, since racists don’t know any black people or anything black culture and history, they make a lot of *assumptions* about blahcks. Based on what they see on TV or reinforce in their families and social circles, apparently they think all black people are wild animals capable of tearing them apart with their bare hands.

        IMO, the most virulent racists today have black ancestry in their genes that they are ashamed of and are trying to hide. The best way to prove you’re racially “pure” is to off a blahck person.

        Technically, Fogen is only half white. That is meaningless to normal people, but he may have felt he had something to prove. He’s preoccupied with race….his own.

    Seems like the State will remain in limbo until the O’Mara presents his self-defense argument tomorrow… the State has advanced past step one-they broke the defendant down. It seems like to me the roles in self-defense are now reversed. Trayvon had the right to defend himself also, so why should it matter who was on top? The irony that the defendant claimed self-defense but his victim was more deserving of it.

    I guess, I needed to step away from the computer because a Windows update took over my laptop right in the middle of the second half of Bernie. I tried to post using tablet but, I guess the I.P. wasn’t recognize and it went to pending, which is understandable.

    I feel better that Bernie put a lot out there that we have been saying but that did not necessarily come up during trial. I liked that he went through the videos and pointed out the (not memory problems) but, the outright lies.

    The psychological understanding of GZ was really well established by BDLR. I wish his presentation was much more logically structured though. He was skipping from one lie to another one and come back to a previous lie without taking sufficient time to systematically demolish them.

    Also, i think he should had separated his argumentation for the manslaughter and M2. Like, now i will show the elements for manslaughter and go on. After that, showed the M2 arguments. I am afraid that the jury will mess everything somewhat like his presentation.

      The jury can ask the judge questions about the charges. The bailiff will take their questions to her and she will send them the appropriate paperwork. I really do think M2 will be the charge though.

    i have my concerns regarding the construction of legal argument. perhaps they are leaving it up to john guy, but they need to do this. yes, at this point, it is established that the defendant is a liar. i think the jury gets it. although it may be fun for us, i think it was too much time.

    disappointed that the power point did not seem to line up well with bernie’s talking points. jurors just had to read small print in a presentation. this is hard to do and easily forgettable without spoken reinforcements. jurors don’t get to look at your power point again.

    they need to match evidence presented to elements of the crime and the only one who can help them is the state. i don’t like that specific evidence (map, clubhouse video, defendant’s work/school history documents) are referred to but not SHOWN and importance demonstrated. i cannot imagine that these jurors want to sift through piles of paperwork to make a decision. jurors need to be pointed to it directly and told how it fits the crime.

    timeline presented by guy, hope it’s solid and he gets the job done. jury still out for me .. for the jury too.

      I hear you but destroying the killer’s credibility in a self defense case like this is vital. It’s not like who killed TM is up in the air so showing that the killer has lied repeatedly and brazenly about significant details about the event itself is key. I suspect Guy will wrap up quite nicely.

        i read that.

        i think he spent too much unorganized time on establishing that the defendant is a liar. in other words, had he been clear and direct instead of colloquial, he could have accomplished more within the time frame.

        before we get to that, we have to prove that a crime was committed and that this was not self defense. perhaps it was important strategically to establish ‘the defendant lies’ before his lawyers speak for him. i expect o’mara will be better organized tomorrow and can only hope guy is as well. elements of the crime must be proved. not self defense can be proved. that the defendant lied is only a portion of the event and how that impacts the crime elements was not outlined.

          I think it was impactful that he gave specific examples over and over. That should drive the point home in the jury room that he is a liar. You can’t believe anything he says.

        They were saying that BDLR had an “OSCAR worthy” performance. A few were laughing and kept saying that a few curse words and not knowing a street is all that Bernie could point to as guilt. Ridiculous.

      The owner apparently is a 40+ guy, formerly manager of a small chain grocery, current employment status unknown.

      They’re all twisted there. It’s been going for a long time but they acquired some new membership with this case. They see themselves as good patriotic and Christian Americans (they have a prayer request corner). They are so ignorant they don’t even know they’re ignorant.

      We keep wader boots for going over there. Nose pegs are also handy and a supply of bleach to bathe in when you come out. Or one of those HazMat suits if you can find one affordable at the army disposals.

          I once posted the sentence “Trayvon Martin was not a thug” over there and half a dozen of them (with several dozen socks) went apeshit for weeks yelling at me that Trayvon Martin was a criminal who had run rampant in five states destroying the world and wreaking havoc and having it all covered up until Fogen finally brought him down with a hollowpoint. They’re radical stupid or, as Rachel would say, “real retarded.”

On the walkthrough with the SPd you can see his wheels turning as he tried to spin the tale.However, like Bernie said in the beginning the forensics tells the story that the defendant did not. There may not have been witnesses to the altercation, but we know what the evidence shows and Bernie said Trayvon speaks to us from the dead through the forensic evidence.

And the news gets everything wrong. It really hurts my heart and soul…it’s so frustrating and I feel so powerless. I want to put Fogen in jail myself! One cannot pursue someone, kill them and claim self-defense!! It’s insane and I’m shocked that anyone thinks otherwise. God help us!!

Establishing that the defendant has NO credibility is important in a case where the jury is being asked to rely on the defendant’s version of events. Showing that the defendant constantly lied about the event is telling. BDLR did a great job at that.

        Disagree too! Connecting the dots, all the defense has to do is knock out a couple details that aren’t important, add a few distractions, and the connected line is messed up.

        What Bernie did, was to give the jurors the knowledge of the arguemtns, his case, the key points of importance, threads of those points, and he allowed the jurors to put things together.

        Defense can’t take that apart as easily, unless they can get into the jury room.

      What I think, is that Bernie not only highlighted most importantly when this all began, back in August 2011, what precipitated in the following months, the reasons for the state of mind towards ‘suspicious’ characters and the false assumption, the decision, for the victim to be profiled as a criminal.

      Most importantly, Bernie left room for the jurors to evaluate the evidence themselves, leading them to points, highlighting the importance, but allowing the jurors to put some of the bits togehter.

      Most importantly, was addressing the biases that may go along with Rachel’s 5 hrous of cross. Bernie defuesed, explained as he humanized Rachel and alerted the jury to precoceptions, or assumptions they may have about her speech, level of education, her inability to read cursive. And Bernie talked about how Rachel called him, the bald headed dude. (which, BTW, was previewed in the last days of testimony, nice pre-empt reminder to the jury, if he isn’t upset nor thinks that is inappropriate or of concern, why should jurors be concerned. Bernie smiled about that the other day.

      Bernie gave the juroras their role, not lecture, but beginning with the justice system and the importance of citizen jurors and personal recognition of the panel taking this seriously and paying good attention throughout.

      Bernie also helped the jurors understand what is important to him in his case, but how to look at it, how to approach it. This is important I’d think, so in a high profile case like this, the jurors will go back to deliberations, without becoming overwhelmed with what they are about to take on.

      bernie never once, diminished the parents of the defendant, he did not even try to argue about what they heard to promote his position.

      But he told it like it is, with the defendant and he backed up each and every point with evidence, and audio visuals, and even mentioned the defendant’s own ‘bullet points’ lists for his ongoing stories.

      Examples, the jurors can take the info, say how the gun was pulled, mannequin and the video statements, and figure things out for themselves. That will help the jurors interest, and inquisitiveness and allow them to solve the problems for themselves, arrive at their own answers.

      But they have the guidelines to the evidence, and have had a good class in what happens when someone makes ASSUMPTIONS, and those assumptions are wrong. They can apply this to their deliberations as well.

      I thought Bernie was excellent. Not that I have much, if anything to compare this to, but if I were a juror, I would feel capable or searching for the answers during deliberation. All the jurors, should feel that way, not just the leaders.

        I totally agree with ay2z. I also think his style of making points showed the jury WHAT to look for in viewing or listening to the tapes an reviewing other evidence and testimony.

        In addition, I think after 3 weeks of testimony, following a point by point flow chart for 2/3 hours would have been boring and he would have lost jurors’ interest.

        Bernie has years of criminal prosecution experience, and I have confidence he knows what he is doing.

      Murder 3 IS a lesser offence but is not automatically included. The State asked to have it included, and Judge have West some time to prepare a response. Apparently on what he found she decided to not include Murder 3.

      When Fred wrote this intro the M3 was still on the table. She only decided against it just before the jury was brought in.

      Makes no difference, he’s gone for Murder 2 anyway.

      There won’t be an appeal. I think not even from GZ. M and W certainly won’t want to continue working for him for free.

      However, with the gun charges, they hold the same weight. West didn’t even realize that today. However, Florida is crazy when it comes to gun law charges. It holds 10-20 years for lesser charge of manslaughter which they added because they knew he did these things but wanted the jury to have something other then M2.

      He is going to jail regardless, unless they say not guilty, and I don’t see these women have children doing this. Because no or even father wants to know that they have a Zimmerman in their neighborhood who may be starching their kids like Zimmerman did. What happens next time it not a black man killing one of their white children, and he was the head of the neighborhood watch.     I’ve opined that the verdict will come down to forensics, and in that regard I think the single most important piece of physical evidence the State should employ is LLMPapa’s demonstration of the mis-alignment of the bullet holes in the garments with the entrance wound.

    Bernie is honest, he doesn’t sugar coat and pick and choose he shows it all, the good, the bad. For example, the honesty about Rachel Jeantel. He didn’t make her out to be someone she is not, he said she was not trying to be someone she is not. He is perfection. Perhaps not the way we see it but if we look at him in a bigger picture his presentation is clear, concise and he makes sure everything is covered. Some of the concerns many had are being addressed. Some of the issues we thought were left out were done so on purpose as to not show the prosecution’s hand. There is a method to the madness, there is thoughtful consideration and cunning and artistic preparation to go for the jugular. He was docile in court but there is no pity party here.

      Officer Smith told Sering Zimmerman “had been battered” and Serino believed that as he did nothing more than tick off Singletons highlights in his first excuse for an interview.
      Smith told Ervin Zimmerman had been “attacked”.

      I’ll never understand why Serino poisoned witnesses by telling them it was ZImmerman screaming, but I suspect Officer Smith told him that.

      Even after the case was fully assigned to Serino, Zimmerman called Officer Smith to ask if he could leave town.

      Officer Smith directly asked Martin’s school for his records- how was that his job?
      Officer Smith told the school something about Martin and Marijuana….how could he have known anything about that?

    So far so good! BDLR has been doing an excellent job so far. He even brought in the “blood-flow” (!!!) that he and his fellow prosecutors were very conspicuously silent on during the case in chief! This tells me that guy knows about every little detail of this case as much as the best among us here on this blog (e.g. Malisha, Fauxy, Nef05, PiranhaMom, Tzar, Xena, Cielo, TwoSides, Rach, etc.). There is a reason why these prosecutors decided to leave a couple of thing unsaid during the case in chief and presented their case the way they did. With a few ineligible errors, the prosecutors in this case have done a fine job. They are not perfect and no prosecutor will ever be. For better or for worse, I stick- and will continue to stick with them.

      exactly, hi tchoupi. what people do not seem to understand here is that the jury has not discussed this for months. There only got a very limited glimpse on matters. I wonder how they will manage to sort that out in the short time they have. If I remember correctly he at one point started to say something about the flow of the blood on the head but never developed it. He only alluded to it to never return. His talk may have been good for our fanbase here, but I am not sure it was good for the jury. O’Mara will show them the easy way out. Reasonable doubt.

      My biggest criticism of defense is that they never developed the idea that no car ever parked in front of the club house. They should have given the jury the chance to look at a half hour, that’s the work you did. That is a crucial extraneous point that could poke a hole into his story other than his own contradictions. I cannot believe it was dropped so easily.

    This shows respect for the jury and engages their attention. This style is effective because it creates a partnership working together toward a solution rather than a passive disengaged audience listening to yet another boring speech.

      In any case we all know now why O’Mara and West felt pretty comfortable concerning whatever cell phone tower data there was. More or less nothing, I guess.

For example, the interrogation where the defendant says Martin was covering his mouth and “pinching” his nose…well play the 911 tape of the screams. Ask the jury, “How is he screaming while his mouth and nose are being covered?” Play the tape when he tells police Martin punched him, knocked him down, mounted him and began a beating….then show pictures of Martin down the T under the yellow tarp. Ask the jury….so how did he get here? How did his body end up midway with items scattered about? Witnesses also say they saw an upright struggle, but yet this man claims he was hit, he went down and a struggle happened. Ask the jury…what does the evidence say that the defendant is not.

        Xena, it’s not that easy. He criticized prosecution for using all the self-serving statements since it feels he thinks they should have made Fogen take the stand. Think about that what you want. Seems I somehow disagreed. I guess the prosecution was well aware that Fogen could well be trained by now, so from their perspective the load of earlier statements are a lot better. On the other hand Shaeffer may be right as far as the jury is concerned. Defense made a lot of officers including Serino state that slight shifts do not matter.

        Serino was overly careful, but at one point he dropped something like: Not at that point. I think in connection to one of these questions. I cannot remember that the prosecution ever picked up on that, to for instance ask Serino at what point he changed his mind and suggested to charge him.

        Concerning Shaeffer, he seems to hold O*’Mara in high esteem.
        That is not my opinion, but one thing I am pretty sure about that he will make a really brilliant and structured argument tomorrow. Not that I like it, but this is just what will happen.

        In a way while BDLR was exactly what I expected–very emotional–I missed exactly what I missed in West’s opening statement. A red line easy to follow for the jury, ideally a red line that both connected to the central evidence presented and challenging the defense’s attempts. He often was all over the place left something untouched and later picked it up again.

        Don’t underestimate O’Mara’s objection at one point. The jury could have gotten the impression he is trying to trick them at that point. Yes, this would have needed some explanations.

        The real problem may not be so much that BDLR did not convince us, after all he offered our perspective, the real problem is that he did not offer them a coherent theory for the jury, did not poke other holes into Fogen’s narrative other than using his own statements against him. The front clubhouse videos come to mind among quite a few other things. I cannot believe they simply let go that part.

        Whonoze, Tchoupi, Amsterdam et al. Didn’t tchoupi show no car ever parks there? That would be efficient for the jury. O’Mara only got the man to agree that yes maybe it could be off plus minus another minute.

        Why did prosecution surrender so fast and so willingly at that point? Mantei didn’t even follow up. What happened? Why did they surrender so easily at that point? since all they rely on is his own inconsistencies?

        So yes, I have quite a few criticisms of prosecution too.

        Remember how everyone here hoped that prosecution must have still something up their sleeves? Were was it?

        Concerning Bill Shaeffer, I did not see the true colors Granny speaks of below. Emotionally he is on the side of Trayvon, I am absolutely sure. What he is saying is that prosecution did not offer a solid case to the jury. And I am afraid I somehow agree.

        Mind you, there still is hope.

        Guy will be forceful and systematic, at least I hope,. Although during the last couple of days my mood has been constantly sinking I have to admit.

    I have to agree with Tasha here. I do the kind of work where you create logical systems and that means showing how one element leads directly to the next. I really think he should be working from a powerpoint or flow chart presentation and explain every point with props. Especially the phone records and locations. Distances. Times. Conclusions. He’s not doing badly, but I expected this portion to be methodical and instead it’s rambling.

    I still contend that the jurors have already decided and this is just confirmation to them. The real debate will happen amongst the six women.
