      In his report Ofc Wagner writes that he took a picture of Trayvon’s head and a picture of gz in Smith’s patrol car, and, yet, does not write that he DID show those pictures to the residents which he actually did.

      I wonder why he left that out of his report.

        I will bet that they showed Fogen’s picture around that night specifically so they could elicit which witnesses were going to say good things about him. THEN they would have a list of witnesses to interview for the next few days so that they could say there was “no evidence to contradict” Fogen’s self-defense story. If, that night, a neighbor saw the picture and either said, “I don’t know him” or “I think that’s the crazy guy who runs around here with a gun chasing Blacks” or “Oh yeah, he’s trouble, I knew he would kill somebody one of these days,” then they would leave his or her name off the list.

    How do you spin everything as posivive for fogen, EVEN when he;s caught in TWO lies by his own experts…. Can you start a petition on the 4th estate for flat out lying????

    Just a little possibly important back ground information on Dr. Di Maio.


    Please take careful note of the first case that is listed. This problem occurred during Di Maio’s tenure at the Bexar County (San Antonio, Tx) Medical Examiners office. I am still digging and suspect that it is very possible that he will be in some way tied to this noted problem.

    Now something else to look at, and I will need a little help with this from someone in the area of Sanford or near by. It was noted early on that the Fogdoit was a registered Democrat so he could not possibly be a racist, do y’all remember that? Now comes Donnolly and his wife claiming that the Fogdoit worked with them in a campaign, for those of you that were involved in the political process in 2007-8 will recall, the GOP (TP?) was known to have suggested people change parties to vote in the primaries to prevent Mz. Clinton winning the nomination, now where I need help, can anyone in the area gain any knowledge as to what campaign Donnolly and his wife were involved in/with in that time frame? My suspicion is that the financial backing for the defense is actually coming from a political source ie. a PAC from the Tea Party. if this could be determined, it would be a major blow to the credibility of the defense members of the Fogdoits legal team….

    One thing that really bugs me is MOM’s constant referring to the Spanish lady’s “prancing” around the courtroom. He is the one who requested her to “prance”. Just pisses me off!

    I strongly believe his excessive weight gain was deliberate so these experts can say he was too big to fight. GZ wasn’t this fat when Trayvon was killed. Nancy Grace laid out how many calories he consume daily. 10,000 daily. She believes it was a strategy for the defense. These are some lawyers!

      I believe that too. Everything this defense team does is scripted and with a purpose. Fogen looked like a menacing skinhead the night he murdered Trayvon, now he’s “Georgie” the Pillsbury doughboy. Nah, I’m not buying it.

    Didn’t they already hash out the contents of Trayvon’s cell phone? What the hell about Fogen’s phone and, what’s contained in it, as well as his text and emails? this is really wrong, for the defense to keep trying to put the victim in this case on trial. UNSEAL FOGEN’S SHIT because his is the only correspondence that really matters here and, yet it’s under protected seal.

    What is in those protected correspondence, that is so incriminating to the defendant, that they remain sealed in the face of Florida’s sunshine laws? what ever was on Trayvon’s phone, should remain out of the public’s view more so than that of HIS MURDERER.

    Fogen does NOT have a right, to make public anything regarding this kid’s cell phone. I guess the Conservative Shit House, is still calling the shots for the defense. the prosecution needs to stop being so damn soft in respect to Fogen’s privacy because, the defense has not given the same consideration to Trayvon Benjamin Martin, THE VICTIM.

GZ entire life is concealed.. just mind blowing… They are not going to find him guilty… And speaking with a group of law enforcement associates they said the DA isn’t trying to fight as they should. The order came down to do minimum and get him off… This is awful… Land of the free if you are wealthy with connections.

      GZ is a child molester, stalker and attacks cops why isn’t this in it goes towards his character… Unbelievable…

    Question about Donnelly. There is no denying he broke the rule of sequestration. He’s sitting there on day 2 and 3 in the videos upthread. I read this bit from The Journal of the American Academy of Psychiatry and the Law:
    “In the event a witness violates sequestration, the
    court has a variety of sanctions available. The most
    extreme remedy is disqualification of the witness.
    The witness may be held in contempt, by reason of
    his conduct, and his testimony is open to comment
    to the jury; but, be it under the permissive or mandatory rule, sanctions in the event of a violation of a
    sequestration order are not obligatory.”

    What I’m wondering is anything else going to happen to him? Could they get him on perjury?
    Hanging out in the courtroom everyday is one thing.
    Hanging out everyday hearing the Lauer 911 call over and over then come and testify that you hadn’t heard it until Saturday for the very first time is another.
    Being an attorney and doing this even worse.
    But claiming you’re an expert and waving your veteran status telling your heart wrenching war stories about knowing screams of near death while lying your ass off is LOW, LOW, LOW.

      yes exactly, and making a point that he deliberately did not engage in any conversation or watch the news specifically because he was a witness……but i personally think it is the defense team that needs to have their asses kicked. They tried to get away with it, they should know better. Throw the book at them!

    Professor, I am afraid you were mistaken when you said a trial “ebbs and flows”.

    It is a roller coaster ride. But instead of normal carriages it uses the Ghost Train and sometimes snakes into the dark Tunnel of Love as well. We have a few people here who scream every time it goes into the top loop. But the only thing to ever fall out is GZ’s defence. Totally panicked and shattered.

    JN lost it a bit tonight. She let them go one inch too far, trying to ensure no chance of an appeal, and they took a mile. Each. For that in the morning she will give them written decisions stopping everything.
    * no animation cartoon
    * no Trayvon’s phone texts or images (again)
    * Donnelly, the video twitchy guy, Di Maio, John G and maybe one other witness in trouble for ignoring the sequestration and/or perjury.

    Defence will waste all day.

    State will bring very few rebuttal witnesses.

    Closing on Friday, after defence cries they had no time to prepare.

    Idiots. You start by pencilling in the closing you want to do, and backfill with the necessary evidence. The opening was a cut-down version of the closing. Except prosecution has backfilled theirs, defence has only helped the prosecution.

    They had a better chance of winning by not calling witnesses at all, because prosecution had left a lot of loose ends (knowing they WILL get more chances when the defence DOES call witnesses).

    I wonder if they won’t put on GZ in the end, after all. In which case prosecution will just cross examine and not call anyone else themselves.

    I think I’m safe in assuming that West will no longer be an attorney after this trial.

    I think I’m also safe in assuming O’Mara and West have a lot to gain from Zimmerman getting acquitted, which is why they’re doing a lot of unethical things to make that happen. Besides the obvious Johnny Cochran comparison, they also potentially have a 7 figure reward waiting for them with their suit against NBC and whoever else.

      fogen has got to be convicted. I’m afraid of what Tracey may do if he’s not. I just get a feeling that Tracey is willing to sacrifice himself in order to avenge his beloved son. fogen MUST go to prison.

      If George is acquitted and the feds file charges against George then West will definitely represent him because West has experience with federal cases and I believe that was the main reason that O’Mara added him in the first place–O’Mara realized shortly after he began representing George last year that the feds were serious about filing charges against George depending on the outcome of the State trial.

    The animation is a synthesis of witness testimony in court, witness statements out of course, and “consultation” with the lawyers. There are several problems with the attempt to introduce it as evidence.

    1.- It’s testimony that cannot be cross-examined.
    2.- It draws conclusions for the jury.
    3.- What lawyers say is not evidence.

    That witness statements were improperly obtained is just icing on the cake. Those three things should make the decision not to allow the animation as evidence a slam dunk.

    If the defendant wishes to tell his story, he needs to tell it from the witness box, not from behind a video projector.

    If the defense wishes to use the animation in its closing statements, that should be ok. Nothing the lawyers say is evidence.

    Look at his expression turn to a big grin. Completely out of sych with what he has just said in his first few words about this being a ‘sad case’. He’s laughing about his upcoming joke, while saying it’s all a sad case.

    Interesting contrast to his behaviour at 9:45 PM Court time.

    Something to consider regarding some discussion above about JN’s “taking back control of her courtroom”:

    JN entertained that cartoon nonsense for FIVE HOURS today, and still could not make a decision about it.

    And then she allowed West to carry on for TWO HOURS – beginning at 8 p.m. (!) – about a settled phone data issue, after she told West that she needed only limited information. But she did not enforce her own instruction. And, again, she could not make a decision about this issue tonight, either.

    And THEN she left in a huff, herself, tonight. I feel for her, but that did not demonstrate control of her courtroom. She was basically badgered out of her own courtroom because she was not in control of it.

    (Also, don’t forget her allowing West to cross-examine Rachel – who had rather limited, though important knowledge about 2/26/12 – for FIVE HOURS.)

    What happened at the end of tonight should not happen in a court of law, and the judge bears considerable responsibility for allowing it to get to the point that it did. Reminded me of Judge Lester, in fact.

    JN has powers available to her to control her courtroom, but she has been unwilling or afraid to use them. And, so, tonight’s fiasco was foreseeable, when you think about it.

    So, JN’s got a long way to go before I can agree that she’s “in control” of her courtroom anywhere close to how I’ve seen judges control their courtrooms.

    I’m not criticizing her, and I strongly agree that JN has many strengths. But, based on what I’ve observed in this case, courtroom control has not been among her demonstrated strengths.*

    And as funny as I found the final proceedings this evening to be, ultimately it saddens me. It’s a sad night for the dignity of courts of law.

    * Just sayin’…. And it doesn’t mean I don’t love her, don’t love y’all, or have “lost faith” in anything.

        Someone brought and interesting observation concerning MOM and West. I was speaking with a former 35 year teacher, she was asked her opinion about them disrespecting her? Amazing she felt the judge is not pretty and men in this area tend to respect pretty women. I never analyzed lawyers respecting older accomplished women.. Judges now are pretty girls and she does appear to be plane but accomplished. This is and interesting point of view from a teacher whom is married to a retired lawyer… Shocking these men are too disrespectful and tends to look down on her….

    They all seem to think W was awesome stickup for poor CAC with that biased judge.

    There was also talk of his website being shut down. They ramble so much and I couldn’t tell what he was talking about but someone was telling him to start another under new name. There was reference to the DOJ.

    I’m deeply angered at GZs actions toward Trayvon the night of 2/26/2012. Several common sense issues concern me greatly and feel they are worth noting and if I were on the jury, would like answers to.

    Why didn’t Trayvon run after JG stepped out and said he was calling the cops? Does it make sense he’d continue to beat up on ‘Georgie’?

    In one of his video statements he ‘over emphasizes’ that he didn’t fight back but says he was defending himself and demonstrates he’s using arms to shield from attack. Why no blood or defensive wounds to his hands, blood on the sleeves of his jacket, if nose was bleeding from sucker punch?

    Why no other bruises to his face, swollen black eyes, busted lip, if he was getting 25-30 MMA punches about the face and head?

    First responders on the scene within mins…no mention of blood on Trayvon’s hands when attempted life saving procedures. So why are the defense, and so called media contributors trying to apply ‘selective’ reasoning when it comes to DNA and forensic? They sound #REAL RETARDED…#HLN contributors, #Zimmerman Defense

      when *john* said he was calling the police ( if that is what he really said ) and Trayvon heard and saw him, THEN Trayvon begged John for help and instead of helping that boy he left him out there with that animal to be killed!

      gz says no one came out to help! but clearly they spoke bc both are saying they did but they aren’t saying the same things.

      and you are right to be concerned about what happened to TM! GZ didn’t get beat up by Trayvon. Trayvon got restrained before he was shot down like an animal with all kinds of ppl listening as he begged and screamed for help. there’s no reason to believe TM was staying there to finish attempting to murder that idiot because he had no motive and there’s no evidence of anything like that other than the statements gz want ppl to believe.

      By the time John saw George and Trayvon both were standing and George was holding Trayvon at gunpoint.

      John flipped the roles. John saw George in control and possibly restraining Trayvon and when John came out Trayvon attempted to use the interruption to get out of George’s grasp and when he realized he couldn’t that’s when Trayvon began begging for help.

      Furthermore John stated that he only saw ten seconds of the event then he turned to call 911.

      John’s story is conflicted because he knows that logically he should have seen George shoot Trayvon so he attempted to move his timeline backwards so he could claim that he didn’t witness the fatal gunshot but witnessed Trayvon in control but it would have taken something from a Hollywood script for George to have gained control on Trayvon from a mounted position and gotten his gun and shot Trayvon between 5 and 15 seconds.

          I believe that John saw the entire thing because someone produced a timeline of the 911 calls and IIRC John’s call was last and about a full minute after the first one.

          There is no telling what type of threats George made against John before he called 911 or maybe proffered the MMA bs before the cops arrived.

          Tzar, I became suspicious of John when he started using approximate times just like George-attempting to fit the events into a timeline.

          I have been in situations where time seemed to stand still and I would never attempt to guess how long it took something to occur because everything is a blur.

    Anyway, my son has only watched bits and pieces of the trial on TV in airports. He thinks Zimmerman is guilty. Z didn’t stay in the truck as ordered by the 911 operator. He thinks Zimmerman focused his efforts to learn everything he could about the SYG law (thus the good grade) and plotted to take advantage of the SYG law. He’d become a neighborhood watch guy, had a story already in place.

    There was a part of Di Maeo’s testimony I found ridiculous and that was that he possibly had a deviation of some kind on his nose that was popped back into place. If this were remotely true the murderer would have been in agonizing pain, if his nose were broken he would be bleeding profusely and someone would notice this deviation. The “expert” that made the comic book, did not use fact in portions of it, instead he relied on not only MOM/Ice Cream Man /Fogdoit, he relied on a witness who’s testimony actually contradicts the findings of the comic book… I predict it will not be allowed as evidence, however it can come in during closing argument because it does not have to factual (nor will it be considered evidence at that point)! The reason the animation will not get in is simple, it is not an accurate presentation and the man who made it used unreliable and possibly false information. It contradicts some of the expert testimony as well as some of the prior witness testimony, so it will not get in. The phone texts and photos are not relevant nor are they proved to be from Trayvon, and there fore they can not be introduced.
    I do predict that come the rebuttal portion from the state, that the texts and the prior history of the Fogdoit will come in. He can be disposed by the state to verify that they are indeed his texts and came from his phone, something that the defense can not do due to their client murdering the alleged owner of the texts and photo’s… I will miss tomorrow morning with another Dr. appointment, perhaps will catch the afternoon session, so I will have to trust that you folks will keep me advised as to what happens in the morning…

      Judge Nelson does not care about the appearance bias. Judge Nelson rules on the matter based on the legality of the argument, so i don’t think the animation will be allowed in as evidence. She may allow it to be used as a demonstration during closing argument.

This should be DENIED in its entirety.

        The funny thing I found is that they got the bin file in Feb and a report that included all the text messages in Feb and then they discovered 600 pictures. How were they going to authenticate a picture on the phone?

        If they wanted to reach all the parties on the text messages they had since Feb AND she said even if they did, it still would not be authenticated by the author anyway….

BIG trouble for O’Mara, West and Zimmerman, because Judge Nelson is furious that TWO violations occurred: first, last night the prosecution brought forward the discovery that Witness Donnell was in the courtroom (in violation of the Court’s Order), prior to giving his testimony yesterday; and second, she discovered tonight during the discussion of the admissibility of the defense’s “infomercial” that Zimmerman’s attorneys were in contact with witnesses to construct the cartoon they are trying to get into evidence (obviously, in lieu of Zimmerman testifying).

      B. Sequestration is a process requiring that witnesses be kept separated from the court proceedings or information therefrom, so that their testimony, when given, is “pure” and not influenced by the proceedings before they testify. After they testify they are permitted to watch the proceedings.

      FYI, evidence of the first instance of the violation of Judge Nelson’s order for sequestration was brought forward by the Leatherman Law Blog.

      Violation of Sequestration means that they were sequestered and still under oath, and was not allowed to take to anyone about the case at all. The guy who was a witness and lived in the community witnessed that he has seen Trayvon on top of Zimmerman. I can’t remember his name. Nevertheless, he was still under oath. However, through the help of MOM, he was advised to tell this guy that made this animation. Which means he talked outside of his sequestration. Because he talked about the case to this guy to recreate the scene. BUSTED

I had filed a motion timely and he said he wouldn’t hear it on motions day and I said that he had heard 17 such motions from my ex on motions day and I had properly noticed it and he said, “I have all these people here who work for me and they need a lunch hour,” and I said, “I was first on the docket but you held me over until this very minute, Your Honor, and I get a half hour for a properly filed motion,” and he shouted, “IF YOU SAY ANOTHER WORD I am leaving this room!” and I said, very sweetly and without raising my voice, “You may.” Whereupon he stormed out and I kept speaking, and the court reporter kept taking down my motion.           But yes yesterday evening marked a new low. I hope that Nelson finds a way to keep the video and messages out. If you are handed the messages with a specific aim, it’s quite possible you misinterpret them (confirmation bias), even more if you have to go back and look at all the evidence and have limited time. The use of both video and messages are suggestive and manipulative are meant to be.

          From Nelson’s perspective CA is a Daubert state, were this creative animation seems to be accepted. So yes, I can understand Nelson wants to reflect on how to make her ruling legally solid.

          So far this woman did a very good job.

    Regarding Zimmerman’s past, remember that we’re still in the defense case portion of the trial. When they are done, the state can then proffer evidence to rebut what O’Mara has brought out. IMO, they presented several witnesses to show Zimmerman was weak, meek, and incapable of anything but smiles. I hope the judge agrees that this opened the door to show that he is anything but.

    However, the time to bring that up is AFTER the defense rests.

    Rachel deposition – in Feb TM told her he won a fight.
    = Strong circumstantial ev. that TM was proud of fighting and drawing blood and was able to prevail in 2nd and 3rd rounds.

    Why relevant?
    Relative physical capabilities of the “parties”
    Jury can determin GZ’s physical capabilities, as well as TM’s. And that includes “knowledge.” But TM’s was a 3-round fight. Shows TM had been in a fight, knew how to fight, and knew what would happen to GZ, b/c it had happened to TM in past.

    State tried to bring this in about GZ, in their questioning of the PA, Fulgate. State made a big deal of the MMA there.

    This info shows TM’s mental state before event, because he told someone about his fight. Rule 903 “emotional condition at the time”, but not on 2/26.

    Shows TM was able to sucker punch by surprise and then was able to mount GZ on his knees.

    We know TM was able to mount GZ, and all physical evidence corroborates that the shot was fired from ground up, GZ shirt was raised by 2 inches or so, and corroborated by J Good.

    Relevand and admiss by Rule 903.

    Florida Constitution and US Constitution compels it because guarantee to face witnesses and due process in defending

    Chambers v. Mississippi, too.

    Rules can’t apply rules to prevent defense from mounting [yes, he used that word] a defense. Especially where the evidence is reliable and trustworthy.

    Loop is closed by Rachel’s testimony, b/c TM told her about winning a fight and winning a fight. It’s reliable – not someone else typing this up – couldn’t be possible now that you’ve heard from Connor.

    High probative value of this very reliable evidence. Necessary to prevent a defense.

        Omar is foolishly trying to use the small flashlight as evidence that a fight happened at the T, too bad for that because, Jon states that as he rounded the corner, after the gunshot, gz was coming towards him and was only about 3 feet away. He also noted that he did not see the small lit flashlight on the ground. In the dark any lit object would instantly attract attention of eyes sweeping the area, as he had to have done before he rounded the corner.

        He then went south to take a picture of the body, so gz was there at the T after the gunshot and could easily have dropped the flashlight then. No way to prove or disprove it, so the small flashlight’s location proves absolutely nothing at all.

        EXCEPT that when the jurors learn these facts about evidence Omar is relying so heavily upon, gz will be toast!
